1. Approve the enclosed Rules of decision making about provision to the receiver of means of the federal budget of the right to assume at the expense of means of the federal budget payment commitments for the term exceeding effective period of the approved limits of the budget obligations.

2. Recognize invalid acts of the Government of the Russian Federation according to the list according to appendix.

3. The rules approved by this resolution are not applied:

concerning drafts of the decisions approved according to the procedure, established by the regulatory legal acts of the Government of the Russian Federation recognized voided according to Item 2 of this resolution on the date of entry into force of this resolution;

when implementing capital investments in the capital construction projects and (or) acquisition of real estate units provided by Articles 78 accepted according to Item 8 of Article 78,. 2, 78.3 or 79 Budget codes of the Russian Federation legal acts, including the legal act of the Government of the Russian Federation about approval of the list of capital construction projects, actions (the integrated investment projects), real estate units which is logging in documents of the comprehensive state program of the Russian Federation "Construction" approved on the date of entry into force of this resolution and also in case of modification of information on capital construction projects, real estate units containing in the specified legal acts;

before completion of implementation of federal target programs in case of acceptance of payment commitments by the receiver of means of the federal budget by the conclusion of public contracts which subjects are performance of works, rendering services for federal state needs, duration of production cycle of accomplishment which rendering exceeds effective period of the approved limits of the budget obligations which financial provision is performed within the means established on the answering purpose by the specified federal target programs;

concerning the decisions of the Government of the Russian Federation on project implementation of public-private partnership, decisions of the Government of the Russian Federation on the conclusion of the concessionary agreement accepted on the date of entry into force of this resolution in case of acceptance and execution by the receiver of means of the federal budget of obligations based on the agreements on public-private partnership signed according to the specified decisions and concessionary agreements, and also concerning decisions on change of such agreements.

4. To provide to the Ministry of Finance of the Russian Federation finishing in the state integrated management information system with public finance "The electronic budget" to the main managers of means of the federal budget of information containing in the perspective financial plan on marginal distribution of expenses of the federal budget to implementation of state programs of the Russian Federation (non-program activities) by codes of classification of expenses (except for the data carried to the state or protected by the law other secret and data of confidential nature) in process of technical readiness of the corresponding functionality, but no later than January 1, 2025.

5. This resolution becomes effective since January 1, 2024.

Rules of decision making about provision to the receiver of means of the federal budget of the right to assume at the expense of means of the federal budget payment commitments for the term exceeding effective period of the approved limits of the budget obligations

I. General provisions

1. These rules establish procedure for acceptance by the Government of the Russian Federation in the form of the legal act of the decision on provision to the receiver of means of the federal budget of the right to assume at the expense of means of the federal budget payment commitments of the Russian Federation for the term exceeding in the cases established by the Budget code of the Russian Federation (further - the Budget code), effective period of the approved limits of the budget obligations, by the conclusion on behalf of the Russian Federation:

a) public contracts which subject is performance of works, rendering services for ensuring federal needs, duration of production cycle of accomplishment which rendering exceeds effective period of the approved limits of the budget obligations, and also public contracts which subject is delivery of goods for ensuring federal needs, for the term exceeding effective period of the approved limits of the budget obligations which conditions provide the counter obligations which are not connected with subject of their execution, the purchases of goods, works, services concluded in accordance with the legislation of the Russian Federation about contractual system in the sphere for ensuring the state and municipal needs based on Article 72 of the Budget code (further - public contracts);

b) agreements (agreements) on provision of subsidy from the federal budget to federal public budget or autonomous institutions according to the paragraph the second Item 1 of Article 78.1 and Article 78.2 of the Budget code, to the federal state unitary enterprises according to Article 78.2 of the Budget code, to legal entities which are not organizations according to Article 78, Items 2 and 4 of Article 78.1 and Article 78.3 of the Budget code, and also to legal entities, individual entrepreneurs, physical persons - producers of goods, works, services for the purpose of financial provision of execution of the state social order on rendering the state services in the social sphere referred to powers of federal executive bodies according to subitems 2 and 3 of Item 1 of Article 78.4 of the Budget code (further respectively - organizations, the companies, other legal entities, the federal social order, contractors of the federal social order, agreement (agreements);
