About temporary procedure for disclosure and provision of information by some Russian economic societies

Due to the need of acceptance of immediate measures in response to the unfriendly and contradicting international law actions of the United States of America and the foreign states and the international organizations which adjoined them and according to the Federal Laws of June 4, 2018 "About corrective actions (counteraction) on unfriendly actions of the United States of America and other foreign states" and of June 4, 2018 No. 133-FZ "About modification of separate legal acts of the Russian Federation and recognition of invalid part 15 of article 5 of the Federal law "About Introduction of Amendments to the Federal Law "About Obligatory Civil Liability Insurance of Owners of Vehicles" and Separate Legal Acts of the Russian Federation" in connection with adoption of the Federal Law "About the Representative for the Rights of Consumers of Financial Services" I decide No. 127-FZ:

1. Approve the enclosed list of the Russian economic societies which have the right to determine independently structure and (or) amount of information which is subject to disclosure and (or) provision.

2. Determine that if disclosure and (or) provision of information which is subject to disclosure and (or) provision according to requirements of the Federal Laws of August 17, 1995 No. 147-FZ "About natural monopolies" of December 26, 1995 No. 208-FZ "About joint-stock companies", of April 22, 1996 "About the security market", of July 27, 2010 No. 208-FZ "About consolidated financial statements" and of July 27, 2010 No. 224-FZ "About counteraction to unauthorized use of insider information and to market manipulation and about modification of separate legal acts of the Russian Federation", will give No. 39-FZ or can lead to introduction of measures of restrictive nature concerning the Russian economic societies and (or) other persons, including concerning person, information on whom the Russian economic society opens and (or) provides, the Russian economic societies included in the list approved by this Decree having the right to determine independently structure and (or) amount of information which is subject to disclosure and (or) provision.

3. If the Russian economic society does not open and (or) does not provide information based on this Decree (except for information, stipulated in Item 3(1) these Decrees), it shall send to the Central bank of the Russian Federation the notification containing such information in the terms established for its disclosure and (or) provision. The form (format) of the specified notification and procedure for its direction are established by regulations of the Central bank of the Russian Federation.

3(1). If the Russian economic society does not open and (or) does not provide information which is subject to disclosure and (or) provision according to requirements of the Federal Law of August 17, 1995 No. 147-FZ "About natural monopolies" based on this Decree, it shall send to Federal Antimonopoly Service the notification containing such information in the terms established by regulatory legal acts of Federal Antimonopoly Service.

4. The information which is not opened and (or) not provided by the Russian economic society based on this Decree, but provided in pursuance of requirements of the legislation of the Russian Federation to federal executive bodies (including on their requests) and to other persons, is not subject to disclosure, including placement in the state information systems and other sources.

5. This Decree becomes effective from the date of its official publication and extends to the legal relationship which arose since July 1, 2023.
