About measures for implementation of the Presidential decree of the Republic of Belarus of May 16, 2023 No. 138
In pursuance of Item 7 of the Presidential decree of the Republic of Belarus of May 16, 2023 "About lease and free use by property" the Council of Ministers of the Republic of Belarus DECIDES: No. 138
1. Approve Regulations on procedure for transfer to legal entities and individual entrepreneurs in free use of the real estate which is in state-owned property under obligations on creation of workplaces it (is applied).
2. Establish the additional raising coefficients applied to base rate when calculating rate of the rent for the areas in buildings according to appendix 1.
3. Determine the list of state bodies and organizations, local executive and administrative organs, legal entities and individual entrepreneurs to which the real estate which is in state-owned property is transferred to free use, according to appendix 2.
4. Make changes to resolutions of Council of Ministers of the Republic of Belarus according to appendix 3.
5. Recognize invalid resolutions of Council of Ministers of the Republic of Belarus according to appendix 4.
6. The agreements of free use by real estate providing transfer to free use of real estate under the obligations which are drawn up by the agreement on creation of workplaces concluded till November 20, 2023:
are performed in accordance with the terms of such agreements taking into account their reduction in compliance with the Presidential decree of the Republic of Belarus of May 16, 2023 No. 138;
are not subject to obligatory reduction in compliance with Regulations on procedure for transfer to legal entities and individual entrepreneurs in free use of the real estate which is in state-owned property under obligations on creation of workplaces, the approved this resolution, and also to prolongation.
7. The agreements of free use by the real estate which is in state-owned property, signed till November 20, 2023 which loan recipients according to this resolution lost the right to such property in free use are subject to termination in connection with unilateral refusal of loaners from their execution.
8. This resolution becomes effective since November 20, 2023.
