RESOLUTION OF THE CABINET OF MINISTERS OF UKRAINE

Some questions of cooperation of the Cabinet of Ministers of Ukraine and Organization for Economic Cooperation and Development in the context of dialogue according to the accession to the Organization

For the purpose of accomplishment of the Memorandum of understanding between the government of Ukraine and Organization for Economic Cooperation and Development on deepening of cooperation and the Program of Organization for Economic Cooperation and Development for Ukraine the Cabinet of Ministers of Ukraine decides:

1. Approve enclosed:

Procedure for giving of request about accession to legal instruments and bodies of Organization for Economic Cooperation and Development;

The actions plan on accomplishment of the Program of Organization for Economic Cooperation and Development for Ukraine (further - the actions plan).

2. To provide to the ministries and other central executive bodies:

accomplishment of the actions plan at the expense of means of the government budget in the expense limits provided for the corresponding year and other sources which are not forbidden by the legislation;

development of the disaggregated actions which will provide step-by-step accomplishment of the tasks determined by the actions plan and their entering into electronic monitoring system and control on the Single web portal of electronic control;

participation in the events held by working bodies of Organization for Economic Cooperation and Development and submission in week time to the Secretariat of the Cabinet of Ministers of Ukraine information on results of participation in such actions.

3. To provide to the minister of the Cabinet of Ministers of Ukraine together with the Secretariat of the Cabinet of Ministers of Ukraine the organization of the work connected with accomplishment of the actions plan.

4. To provide to the secretariat of the Cabinet of Ministers of Ukraine:

interaction with the Secretariat of Organization for Economic Cooperation and Development on accomplishment of the Program of Organization for Economic Cooperation and Development for Ukraine and together with Office of reforms to adjust system operation on exchange of information about its accomplishment;

the organization of carrying out monitoring of accomplishment of the actions plan on the Single web portal of electronic control.

5. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the enclosed list.

Procedure for giving of request about accession to legal instruments and bodies of Organization for Economic Cooperation and Development

1. This Procedure determines procedures of preparation and giving of request about accession to legal instruments and bodies of OECD.

2. In this Procedure terms are used in the following sense:

the legal instrument the OECD document developed by bodies of OECD and approved by Council of OECD in the form of recommendations, conventions, declarations, codes, etc.;

the body the OECD working body formed by OECD (committee, working group etc.) who, in particular, develops legal instruments of OECD and carries out the analysis of state policy of the countries in various spheres.

3. Methodical maintenance of processes of preparation of requests about accession to legal instruments and bodies of OECD is performed by the Secretariat of the Cabinet of Ministers of Ukraine.

4. The ministry, other central executive body or the state collegiate organ (in consent) (further - the initiator) which suggests to join the legal instrument of OECD, carries out the analysis of the legislation of Ukraine, the principles of state policy, procedures and the practician of actions of public authorities concerning compliance to provisions of the legal instrument of OECD.

5. In case when by results of the carried-out analysis it is determined that the legislation of Ukraine corresponds to provisions of the legal instrument of OECD, the initiator prepares the offer on accession to the legal instrument of OECD on form according to Appendix 1, which goes for processing and coordination with all interested state bodies within which competence the questions determined by the legal instrument of OECD are.

If by results of the carried-out analysis it is determined that the legislation of Ukraine in parts or in full does not correspond to provisions of the legal instrument of OECD, the initiator develops and submits the drafts of acts necessary for ensuring coordination of the legislation with such provisions for consideration of the Cabinet of Ministers of Ukraine. After adoption of such acts preparation and further study of the offer on accession to the legal instrument of OECD according to this Procedure is performed.

6. After coordination of the offer on accession to the legal instrument of OECD with all interested state bodies the initiator in case of need finishes the offer and sends it to the Secretariat of the Cabinet of Ministers of Ukraine together with the translation into English of Section 3 of the offer.

The unofficial translation of the legal instrument of OECD into state language is also applied to the offer.

7. The secretariat of the Cabinet of Ministers of Ukraine carries out the analysis of the submitted proposal on accession to the legal instrument of OECD concerning compliance to the requirements to form and the procedure established by this Procedure and in case of lack of notes to it at the request of the Vice-Prime Minister concerning the European and Euro-Atlantic integration of Ukraine develops and approves according to the procedure, established by the Regulations of the Cabinet of Ministers of Ukraine approved by the resolution of the Cabinet of Ministers of Ukraine of July 18, 2007 No. 950 (The Official Bulletin of Ukraine, 2007, No. 54, Art. 2180; 2011, No. 88, the Art. 3199), the draft of the act of the Cabinet of Ministers of Ukraine concerning approval of the letter of the Government of Ukraine to OECD about request concerning accession to the legal instrument of OECD.

8. In case the proposal on accession to the legal instrument of OECD is submitted with violation of the requirements to form and the procedure established by this Procedure or the available notes to it, such offer not later than within ten working days after its receipt returns to the initiator the letter signed by the State secretary of the Cabinet of Ministers of Ukraine or one of his deputies according to distribution of obligations together with offers concerning ways of its completion.

9. The draft of the act of the Cabinet of Ministers of Ukraine concerning approval of the letter of the Government of Ukraine to OECD about request concerning accession to the legal instrument of OECD is submitted for consideration of the Cabinet of Ministers of Ukraine by the Vice-Prime Minister concerning the European and Euro-Atlantic integration of Ukraine.
