About approval of the Regulations on the Commission on questions of nationality in case of the President of the Russian Federation

1. Approve the enclosed Regulations on the Commission on questions of nationality in case of the President of the Russian Federation.

2. Recognize invalid:

The presidential decree of the Russian Federation of November 14, 2002 No. 1318 "About approval of the Regulations on the Commission on questions of nationality in case of the President of the Russian Federation and its structure" (The Russian Federation Code, 2002, No. 46, the Art. 4570);

Regulations on the Commission on questions of nationality in case of the President of the Russian Federation

1. The commission on questions of nationality in case of the President of the Russian Federation (further - the Commission) is the advisory and consultative body in case of the President of the Russian Federation providing realization of the constitutional powers of the head of state according to the solution of questions of citizenship of the Russian Federation and provision of political asylum, and also considering questions of support of resettlement to the Russian Federation of separate categories of foreign citizens and stateless persons.

2. The commission in the activities is guided by the Constitution of the Russian Federation, the Federal constitutional Laws, the Federal Law of April 28, 2023 No. 138-FZ "About citizenship of the Russian Federation", other Federal Laws, decrees and orders of the President of the Russian Federation, and also this Provision.

3. Regulations on the Commission and its structure affirm the President of the Russian Federation.

4. The main objectives of the Commission are:

a) information and analytical support of activities of the President of the Russian Federation for realization of the powers assigned to it by the Constitution of the Russian Federation and the Federal Law of April 28, 2023 No. 138-FZ "About citizenship of the Russian Federation" according to the solution of questions of citizenship of the Russian Federation and provision of political asylum;

b) preparation and representation to the President of the Russian Federation of suggestions for improvement of state policy in the field of citizenship of the Russian Federation, to development of institute of the Russian citizenship;

c) preparation and representation to the President of the Russian Federation of suggestions for improvement of the legislation in the field of citizenship of the Russian Federation and legal regulation in the field of provision of political asylum, and also according to the problem resolution, arising in these areas;

d) consideration of questions of impossibility of the termination by citizens of the Russian Federation of nationality (citizenship) of foreign state for the reasons which are not depending on them for the purpose of implementation of article 26 of the Federal Law of April 30, 2021 No. 116-FZ "About modification of separate legal acts of the Russian Federation" and adoption of relevant decisions;

e) coordination of interaction of the bodies knowing cases on citizenship of the Russian Federation;

e) consideration according to decrees, orders, orders and instructions of the President of the Russian Federation of other questions which are within the competence of the Commission.

5. The main functions of the Commission are:

a) preliminary consideration of statements concerning citizenship of the Russian Federation, addresses for acceptance to citizenship of the Russian Federation in exclusive procedure, petitions for provision of political asylum in the Russian Federation, preparation and representation to the President of the Russian Federation of relevant proposals;

b) preliminary consideration of the conclusions of the bodies knowing cases on citizenship of the Russian Federation on applications for admission in citizenship of the Russian Federation and materials on this matter in the presence of the circumstances provided by subitems "b", "e" - "to" Item 1, Items 2 and 3 of Article 18, part 2 of article 44 of the Federal Law of April 28, 2023 No. 138-FZ "About citizenship of the Russian Federation", preparation and representation to the President of the Russian Federation of offers on possibility of coordination of relevant decisions about acceptance in citizenship of the Russian Federation;

c) preliminary consideration of the conclusions of the bodies knowing cases on citizenship of the Russian Federation, and materials about availability of the bases of the termination of citizenship of the Russian Federation provided by the subitem "an" of Item 2, Item 3 of part 1 of article 22 of the Federal Law of April 28, 2023 No. 138-FZ "About citizenship of the Russian Federation" if decisions on acceptance in citizenship of the Russian Federation were made by the President of the Russian Federation, preparation and representation to the President of the Russian Federation of offers on possibility of the termination of citizenship of the Russian Federation of the corresponding persons;
