About ensuring realization of sectoral economic and other rationing arrangements (sanctions) against financial institutions of the Russian Federation

According to the laws of Ukraine "About sanctions", "About state regulation of activities for the organization and carrying out gamblings", "About the state lotteries in Ukraine", the decision of the National Security and Defense Council of Ukraine of February 22, 2023 "About application of sectoral special economic and other rationing measures (sanctions) against financial institutions of the Russian Federation", No. enacted by the Presidential decree of Ukraine of February 22, 2023 89, and No. 2924-IX approved by the resolution of the Verkhovna Rada of Ukraine of February 23, 2023, subitem 3-1 of item 4 of the Regulations on the Commission on regulation of gamblings and lotteries approved by the resolution of the Cabinet of Ministers of Ukraine of September 23, 2020 No. 891, for the purpose of ensuring realization of sectoral special economic and other rationing measures (sanctions) against financial institutions of the Russian Federation, the commission on regulation of gamblings and lotteries of RESHILA:

1. To organizers of gamblings, operators of the state lotteries and subjects of managing - the residents of Ukraine who obtained license for activities on provision of services in the sphere of gamblings during the term of application of sectoral special economic and other rationing measures (sanctions) against all banks registered / having the location in the Russian Federation including to the Central bank of the Russian Federation, non-bank credit institutions, operators of payment systems, professional participants of the stock market, the insurance companies, investment funds and other organizations registered / having the location in the Russian Federation the providing financial services (further - financial institutions of the Russian Federation):

1) not to perform operations (not to make actions), which lead to violation, avoidance of the introduced restrictions;

2) to stop transactions with the assets belonging to financial institutions of the Russian Federation;

3) not to establish business relations, including correspondence relations, with financial institutions of the Russian Federation;

4) not to make transactions with financial institutions of the Russian Federation;

5) not to maintain business relations with financial institutions of the Russian Federation, including correspondence relations, in case of lack of assets on accounts of such organizations;

6) not to acquire securities and other financial instruments which issuers are financial institutions of the Russian Federation, except for alienations (including free) securities for benefit of the state of Ukraine;

7) to stop accomplishment of economic and financial liabilities for benefit of financial institutions of the Russian Federation, including on transfer of dividends, percent and other payments for the assets attracted to Ukraine;

8) not to perform investments on advantage of financial institutions of the Russian Federation;

9) to stop servicing of the electronic means of payment (including transfers, implementation of calculations and cash disbursement) emitted by financial institutions of the Russian Federation;

10) not to enlist funds for customer accounts - physical/legal entities on the translations initiated with use of the electronic means of payment emitted by financial institutions of the Russian Federation.

2. To organizers of gamblings, operators of the state lotteries during the term of application of sectoral special economic and other rationing measures (sanctions) quarterly to the 25th day of the last month of the accounting period to inform the Commission on regulation of gamblings and lotteries on attempts of carrying out financial transactions by physical persons which lead to violation, avoidance of the restrictions introduced by Item 1 of this decision.

3. To subjects of managing - the residents of Ukraine who obtained license for activities on provision of services in the sphere of gamblings during the term of application of sectoral special economic and other rationing measures (sanctions) quarterly to the 25th day of the last month of the accounting period to inform the commission on regulation of gamblings and lotteries on attempts of carrying out financial transactions by physical persons and/or legal entities which lead to violation, avoidance of the restrictions introduced by Item 1 of this decision during provision of services on delivery and/or provision of the software that is directly used in the sphere of the organization and carrying out gamblings.

4. To provide to department of methodology together with department of legal providing in the procedure established by the legislation submission of this decision on state registration in the Ministry of Justice of Ukraine.

5. To provide to department of documentary providing and organizational work promulgation of this decision after its state registration.

6. Department of licensing in the sphere of gamblings and lotteries during the term of application of sectoral special economic and other rationing measures (sanctions) quarterly to the 5th following the accounting period to inform the Ministry of Finance of Ukraine on results of realization and monitoring of efficiency of sectoral special economic and other rationing measures (sanctions) in financial institutions of the Russian Federation provided by Items 2 and 3 of the Decision of the National Security and Defense Council of Ukraine of February 22, 2023 "About application of sectoral special economic and other rationing measures (sanctions) against financial institutions of the Russian Federation", No. enacted by the Presidential decree of Ukraine of February 22, 2023 89, and No. 2924-IX approved by the Resolution of the Verkhovna Rada of Ukraine of February 23, 2023.

7. This decision becomes effective from the date of its official publication.

8. Control over the implementation of this decision to assign to the Chairman of KRAIL.
