About some questions of provision of exclusive export right of separate types of coals

According to Items 2 and 4 of article 20 of the Law of the Republic of Kazakhstan "On regulation of trading activity", the subitem 2) of article 10 of the Law of the Republic of Kazakhstan "About permissions and notifications", articles 29 and 47 of the Agreement on the Eurasian Economic Union, and also the Section 10 of appendix 7 to the Agreement on the Eurasian Economic Union the Government of the Republic of Kazakhstan DECIDES:

1. Approve enclosed:

1) the list of separate types of coals for which export the exclusive right is granted;

2) the list of participants of foreign trade activity which are granted exclusive right;

3) Rules of suspension or cancellation of the exclusive license for export of separate types of coals.

2. Determine Committee of the industry of the Industry ministry and construction of the Republic of Kazakhstan by the licensor on implementation of issue of the exclusive license for export of separate types of the coals provided by the subitem 1) of Item 1 of this resolution.

3. Effective period of the exclusive license for export of separate types of coals constitutes one year from start date of its action and can be limited by effective period of the agreement in foreign trade (contract) or effective period of the document which is the basis for issue of the exclusive license.

4. To industry ministry and constructions of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan to take the measures following from this resolution.

5. This resolution becomes effective since December 1, 2023.

Rules of suspension or cancellation of the exclusive license for export of separate types of coals

Chapter 1. General provision

1. These rules of suspension or cancellation of the exclusive license for export of separate types of coals (further – Rules) are developed according to part four of Item 7 of Article 37 and article 45 of the Law of the Republic of Kazakhstan "About permissions and notifications", Items 19 and 20 of Rules of issue of licenses and import permits and (or) commodity import (appendix to appendix No. 7 to the Agreement on the Eurasian Economic Union of May 29, 2014), and also the Decision of Board of the Eurasian economic commission of April 19, 2016 No. 34 "About application of measures of non-tariff regulation" and determine procedure for suspension or cancellation of the exclusive license for export of separate types of coals (further – the exclusive license) issued by Committee of the industry of the Industry ministry and construction of the Republic of Kazakhstan according to this resolution.

2. For the purposes of these rules the following concepts are used:

1) licensor – Committee of the industry of the Industry ministry and construction of the Republic of Kazakhstan;

2) the licensee – the participant of foreign trade activity to whom the exclusive export right of separate types of coals according to this resolution is provided.
