About approval of the Technique of environmental impact assessment in areas of fall of the separated parts of carrier rockets
According to subitem 6 of article 87 of the Ecological code of the Republic of Kazakhstan, I ORDER:
1. Approve the Technique of environmental impact assessment in areas of fall of the separated parts of carrier rockets according to appendix to this order.
2. To provide to committee of ecological regulation and control of the Ministry of Ecology and Natural Resources of the Republic of Kazakhstan in the procedure established by the legislation:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) placement of this order on Internet resource of the Ministry of Ecology and Natural Resources of the Republic of Kazakhstan after its official publication;
3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Ecology and Natural Resources of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.
4. To impose control of execution of this order on the supervising vice-Minister of Ecology and Natural Resources of the Republic of Kazakhstan.
5. This order becomes effective after ten calendar days after day of its first official publication.

to the Order of the Minister of Ecology and Natural Resources of the Republic of Kazakhstan of November 15, 2023 No. 321
1. The technique of evaluating impact on the environment in areas of fall of the separated parts of carrier rockets (further - the Technique) is developed according to the subitem 6) of article 87 of the Ecological code of the Republic of Kazakhstan (further - the Code) and determines procedure and the mechanism of evaluating impact on the environment in areas of fall of the separated parts of carrier rockets.
2. In this Technique the following concepts and determinations are used:
1) the Baikonur spaceport - the territory which is component of space infrastructure also includes the technical, starting, landing complexes, the parcels of land intended for preparation and implementation of starts of space objects;
2) the Baikonur complex - the test, technological, scientific, technological, social and providing objects of the Baikonur spaceport and the city of Baikonur with personal and real estate;
3) authorized body in the field of space activities (further – authorized body) – the central executive body performing management in the field of space activities and also in limits, stipulated by the legislation the Republic of Kazakhstan – cross-industry coordination.
4) the area of inspection – the territory determined by the customer for work of environmental impact assessment with indication of geographical coordinates of rotary points of the inspected parcel of land within which effects of impact of space-rocket activities around fall of the separated parts of carrier rockets, the adjacent territory, impact of launch of rockets carriers on the territory of the Baikonur spaceport and the subroute territories are estimated.
5) the customer of the project documentation of environmental impact assessment (further – the customer) - the person who is responsible for preparation of documentation on the planned activities and submitting documentation on the planned activities on environmental assessment;
6) the carrier rocket – the technical device intended for conclusion of spacecrafts in space;
7) the separated parts of rockets carriers - the structural elements of the rocket which are separated it in the course of regular functioning on the active site of trajectory of flight;
8) the area of fall of the separated parts of carrier rockets – the parcel of land on which fall (land) fulfilled and separated in you weed elements and (or) fragments of carrier rockets;
9) environmental impact assessment in areas of fall of the separated parts of carrier rockets (further - environmental impact assessment) - process of identification, studying, the description and assessment on the basis of the corresponding researches of possible essential impacts of space-rocket activities in the position area of the Baikonur spaceport, the subroute territories, around fall of the separated parts of carrier rockets, the adjacent territory on the environment and health of the person, development of measures for prevention of adverse effects (destruction, degradation, damage and depletion of natural ecological systems and natural resources), to improvement of the environment taking into account requirements of the ecological legislation of the Republic of Kazakhstan;
10) the disaster zone of the route - the figure on the Earth's surface extended along the emergency route and limited to the left and right borders maximum (with the set probability) side dispersion of points of fall of rockets carriers. Width of the disaster zone is determined by the emergency situations leading to the maximum variation of flight of rockets carriers in the side direction;
11) the route of start-up - projection of trajectory of flight of the rocket of space appointment to the land surface;
12) the adjacent territory – the territory adjacent to the area of fall at distance at least 40 kilometers from border of the area of fall;
3. The designations and reducings used in the Technique:

4. Development of environmental impact assessment is performed by the physical and (or) legal entities having the license for performance of works and rendering services in the field of environmental protection according to the Law of the Republic of Kazakhstan "About permissions and notifications".
5. Evaluating impact on the environment in areas of fall of the separated parts of carrier rockets includes:
1) preparatory work of environmental impact assessment;
2) planning of environmental impact assessment;
3) final stage of environmental impact assessment.
6. Preparatory work of environmental impact assessment contains:
determination of the purposes, tasks, objects and terms of evaluating impact on the environment performed within the specification on evaluating impact on the environment;
preparation of provisional estimate of impact on the environment containing the short description, the analysis of alternative options, data on location, coordinates, general information about the surrounding and social and economic circle containing the landscape characteristic, land and regional features of the territory; data on state of environment, anthropogenous violation of components, special conditions (availability of the increased seismicity, natural hazards and processes); the characteristic of natural value of the area of the planned activities, the historical and cultural importance, availability of especially protected natural territories and objects; materials about social and economic features of the territory (economic, town-planning use of the territory);
the analysis of alternative options provides designing of several routes of launch of rockets carriers and areas of fall of the separated parts of carrier rockets for safety of the population.
7. The provisional estimate of impact to the environment with alternative options goes to the interested state bodies or consultations with them are held.
8. State bodies within thirty working days from receipt date of provisional estimate of impact on the environment with alternative options represent the answer about results of their consideration.
9. By results of consideration by state bodies, the customer options with risk of damnification of life and to health of the population, emergence of emergency situation, destruction or loss of biodiversity regarding objects vegetable and (or) fauna or their communities which are rare or unique are excluded.
