About approval of the Regulations on regulation of activities of bureau of credit histories

According to Articles 7, 15, 55-1, 56, 57 Laws of Ukraine "About the National Bank of Ukraine", Articles 3, 15, 16 Laws of Ukraine "About the organization of forming and the address of credit stories", for the purpose of settlement of activities of bureau of credit histories, establishment of procedure for coordination of the Provision of Bureau of credit histories by the National Bank of Ukraine, changes in it and procedure of control of activities of the bureau of credit histories Board of the National Bank of Ukraine DECIDES:

1. Approve the enclosed Regulations on regulation of activities of bureau of credit histories.

2. Bureau of credit histories (further - Bureau) till October 20, 2023 to provide to the National Bank of Ukraine (further - National Bank) e-mail addresses for implementation of official communication between National Bank and Bureau by provision:

1) the notification electronically with imposing of the qualified digital signature (further - KEP) on official electronic mailbox of National Bank: nbu@bank.gov.ua or

2) letters in paper form with simultaneous obligatory submission of the electronic copy of the sent letter without imposing of KEP on digital data carriers (USB флешнакопителях).

3. Declare invalid the resolution of Board of the National Bank of Ukraine of December 29, 2020 No. 171 "About approval of the Regulations on control of activities of bureau of credit histories".

4. To department of methodology of regulation of activities of non-bank financial institutions (Sergey Savchuk) after official publication to inform Bureau information on adoption of this resolution.

5. The resolution becomes effective from the date of, its official publication following behind day.

Regulations on regulation of activities of bureau of credit histories

I. General provisions

1. this provision is developed according to requirements of the Law of Ukraine "About the National Bank of Ukraine" (further - the Law On National Bank), the Law of Ukraine "About the organization of forming and the address of credit stories" (further - the Law), for the purpose of regulation of activities of bureau of credit histories (further - Bureau).

2. This Provision establishes:

1) procedure for coordination by the National Bank of Ukraine (further - National Bank) Provisions of Bureau (rules of forming and maintaining credit stories which affirm executive body of Bureau and agree authorized body) (dalee-Polozheniye Bureau), changes in the Provision of Bureau;

2) procedure National Bank of control of activities of Bureau.

3. Terms in this Provision are used in the following values:

1) the electronic copy of the document - the visual representation of the paper document electronically received by scanning of the original of the paper document which original compliance attested qualified digital signature (further - KEP) that is imposed on the document with observance of requirements of the legislation of Ukraine in the sphere of electronic confidential services and electronic document management;

2) the authorized person concerning control of activities of Bureau Chairman of National Bank, the First Deputy Chairman of National Bank, the vice-chairman of National Bank, the head of the structural unit of National Bank to which functions control of compliance of activities of Bureau to requirements of the legislation of Ukraine in the sphere of forming and the address of credit stories according to the powers of National Bank determined by the Law or person which is carrying out its obligations belongs;

3) the authorized person concerning coordination of the Provision of Bureau - The chairman of National Bank, the First Deputy Chairman of National Bank, the vice-chairman of National Bank, the head/deputy the head/division manager (person fulfilling its duties) as a part of structural division of National Bank to which functions coordination of the Provision of Bureau, changes in the Provision of Bureau belongs.

Other terms in this Provision are used according to the determinations specified in the Law.

4. The provisions of Bureau, and also change in the Provision of Bureau given to National Bank for the purpose of their coordination according to requirements of this provision become effective from the date of their coordination by National Bank.

II. Procedure for consideration and coordination of the Provision of Bureau by National Bank, changes in the Provision of Bureau

5. Documents (the copy of documents) provided to Bureau in National Bank according to the Section II of this provision shall be drawn up according to requirements of the Section IV of this provision.

6. The bureau for review of the Provision of Bureau files the following documents to National Bank:

1) the petition for coordination of the Provision of Bureau constituted in any form and signed by the head or the authorized representative of Bureau. The petition shall contain the e-mail and postal address of Bureau, contact phone number of the head or authorized representative of Bureau for communication with National Bank;

2) the copy of the Provision of the Bureau meeting the requirements of the law, this provision, approved by executive body of Bureau;

3) copy of the decision of executive body of Bureau on approval of the Provision of Bureau;

4) the copy of the charter of Bureau (moves if the copy of the charter of Bureau did not move in National Bank and/or in the presence of changes in the charter of Bureau from the moment of preliminary submission of the copy of the charter of Bureau to National Bank earlier);

5) the copy of the document confirming powers of the authorized representative on representation and signing of documents on behalf of Bureau (except the head of Bureau, information on which contains in the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming).
