About approval of the Instruction for determination of category of the object making negative impact on the environment
According to the subitem 357) of Item 15 of the Regulations on the Ministry of Ecology and Natural Resources of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of July 5, 2019 No. 479 I ORDER:
1. Approve the Instruction for determination of category of the object making negative impact on the environment according to appendix to this order.
2. To provide to committee of ecological regulation and control of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:
1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;
2) placement of this order on Internet resource of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan after its official publication;
3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of ecology, geology and natural resources of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.
3. To impose control of execution of this order on the supervising vice-minister of ecology, geology and natural resources of the Republic of Kazakhstan.
4. This order becomes effective after ten calendar days after day of its first official publication.

This Instruction for determination of category of the object making negative impact on the environment (further - the Instruction) is developed according to the subitem 357) of Item 15 of the Regulations on the Ministry of Ecology and Natural Resources of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of July 5, 2019 No. 479 and disaggregates determination of category of the object making negative impact on the environment.
2. The basic concepts and determinations used in the Instruction:
1) vibration – mechanical oscillations in the equipment (machines, mechanisms, designs, engines and others);
2) source of harmful physical impacts – object during which work there is transfer to the environment of harmful physical factors (technological installation, the device, the device, the aggregate and others); Maximum permissible level of negative physical impact is understood as the maximum level of separate types of physical impact (noise, vibration, electric, electromagnetic, magnetic fields, radiation, heat) in case of which there are no harmful effects on condition of animals, plants, ecological systems and biodiversity;
3) infrasound – noise which frequency characteristics are out of the range of audibility of human ear, in the field of the frequencies of one hertz – twenty hertz (further – Hz);
4) object (I and II category) - stationary technological object (the company, production) within which one or several types of activity specified in Section 1 (for objects І categories) or Section 2 (for category objects II) Appendices 2 to the Ecological code of the Republic of Kazakhstan are performed (further – the Code) and also technologically directly related any other types of activity which are performed within the same industrial platform on which such object is placed;
5) object (III category) – the building, construction, their complex, the platform or the territory within which the types of activity specified in Section 3 of Appendix 2 to the Code are performed;
6) the operator of object - the physical person or legal entity, in property or other legal use of which is the object making negative impact on the environment. Operators of object the physical persons and legal entities involved by the operator of object for accomplishment of separate works and (or) rendering separate services in case of construction, reconstruction, operation and (or) liquidation (post-utilization) of the object making negative impact on the environment are not recognized;
7) physical impact on the environment – the maximum permissible level of negative impacts of noise, vibration, electric, electromagnetic, magnetic fields, radiation and heat on condition of animals, plants, ecological systems and biodiversity;
8) ultrasound - ultrasonic fluctuations in the range of frequencies from 1, 12 x 104 to 1, 0 x 109 Hz which are transferred in air, liquid and firm circles;
9) noise – the sounds which are adversely operating on human body, preventing its work and rest. Sound vibrations in the range of the heard frequencies, capable to make harmful effects on safety and health of the worker;
10) electromagnetic radiation – the electromagnetic oscillations created by natural or artificial source;
