1. Approve the enclosed Rules of the organization of activities in the field of counteraction to terrorism in the Republic of Kazakhstan.

2. Declare invalid the order of the Government of the Republic of Kazakhstan of March 30, 2005 No. 284 chipboard.

3. This resolution becomes effective after ten calendar days from the date of the first official publication.

Rules of the organization of activities in the field of counteraction to terrorism in the Republic of Kazakhstan

1. General provisions

1. These rules of the organization of activities in the field of counteraction to terrorism in the Republic of Kazakhstan (further - Rules) determine procedure for the organization of activities in the field of counteraction to terrorism in the Republic of Kazakhstan.

2. Counteraction to terrorism - activities of state bodies and local government bodies on:

to terrorism prevention;

to identification, suppression of terrorist activities, disclosure and investigation of terrorist crimes;

minimization and (or) mitigations of consequences of terrorism by rendering the emergency medical care, medico-psychological maintenance, holding rescue and fire-proof actions, recovery of normal functioning and ecological safety of the objects which underwent to terrorist impact, social resettlement of persons injured with the act of terrorism, and persons participating in its suppression, compensations of moral and material harm to persons injured with the act of terrorism.

3. Coordination of activities for counteraction to terrorism is performed:

bodies of homeland security within the permanent Anti-terrorist center of the Republic of Kazakhstan which is created under authorized state body on coordination of activities in the field of counteraction to terrorism;

akimats of areas, cities of republican value, the capital, areas (cities of regional value) within the anti-terrorist commissions which are created under local executive body of area, city of republican value, the capital, area (city of regional value).

4. If necessary other state bodies also can be involved in activities for counteraction to terrorism within the competence.

5. Local executive bodies coordinate activities of territorial subdivisions of the central state bodies and local government bodies for terrorism prevention, and also minimization and (or) mitigation of consequences of terrorism in the corresponding territory through the anti-terrorist commissions.

For implementation of their decisions legal acts of bodies which representatives are part of the relevant commissions can be published.

2. Procedure for prevention of terrorism

Activities of state bodies and local government bodies for prevention of terrorism are performed within their competence according to the laws of the Republic of Kazakhstan "About counteraction to terrorism" and "About prevention of offenses" by means of realization of package of measures during which political, social and economic, information and propaganda, educational methods, and also the methods of physical, technical protection and the legal prevention having priority value for decrease in level and scale of terrorist threats are used.

7. Prevention of terrorism is understood as complex of the legal, economic, social, organizational, educational, propaganda and other measures performed by the state and local executive bodies on identification, studying, elimination of the reasons and conditions promoting origin and distribution of terrorism.

8. The administrative, criminal, organizational and other measures directed to enhancement of the mechanism of responsibility for non-compliance with requirements of the anti-terrorist legislation and inevitability of punishment for the committed terrorist crimes, corruption offenses, arms trafficking, ammunition, explosives, drugs, psychotropic substances and their precursors, radioactive materials, dangerous biological substances and chemical reagents, terrorism financing, and also regulation of migratory processes and procedure for use of information and communication systems, including blockings of Internet resources of extremist and terrorist orientation belong to legal measures.

The measures directed to improvement of social and economic situation in certain regions and equalization of the level of development of regions, unemployment liquidation, reducing marginalization of the population, reduction of property differentiation, ensuring social protection of the population belong to economic and social measures.

10. Measures belong to organizational measures on:

1) to systematic informing citizens on range of terrorist threats, instilling of skills of actions in them in critical situation and to participation in overcoming negative effects of acts of terrorism;

2) to the differentiated training of different social, professional and age groupes of the population in methods of identification of signs of preparation of terrorist attacks and their potential contractors;

3) to regular check of readiness of citizens for actions in the conditions of emergency situations by carrying out special doctrines and training classes in the residence or work;

4) to explanation to the population of questions of fight against terrorism for the purpose of mobilization of citizens on active cooperation with law enforcement and special state bodies in this area;

5) to development and implementation of target programs and actions for ensuring protection of objects with technical means, vulnerable in the terrorist relation;

6) to improvement of technical equipment of the state bodies performing identification, suppression of terrorist activities, disclosure and investigation of terrorist crimes.

11. Measures belong to educational measures on:

1) to patriotic education of youth at all levels of education system;

2) to increase in general education level of citizens;

3) to creation of effective system of education of citizens regarding the cultural and confessional diversity, historical unity of residents of the country, history of religious intolerance, genocide and other crimes generated by extremism and terrorism.

12. Propaganda measures are performed within information and propaganda counteraction to terrorism.

Information and propaganda counteraction to terrorism is performed for the purpose of:

explanations of danger of terrorism;

revelations of forms, methods and acceptances by means of which terrorists perform promotion of the views and the ideas;

forming in the society of anti-terrorist consciousness;
