Based on part (6) article 3 of the Law No. 420/2006 on technical regulation (repeated publication: The official monitor of the Republic of Moldova, 2017, No. 92 - 102, the Art. 125), with subsequent changes, DECIDES: the Government

1. Approve the Technical regulation about crystal glass it (is applied).

2. This resolution becomes effective after 12 months from the date of publication in the Official monitor of the Republic of Moldova.

The technical regulation about crystal glass

The technical regulation about crystal glass shifts the Directive of Council No. 69/493/CEE of December 15, 1969 about rapprochement of the laws of the state members concerning crystal glass published in the Official magazine of the European Union by L 326 of December 29, 1969 with the last amendments made by the Directive of Council 2006/96/EC of November 20, 2006, Bulgaria adapting some directives in the field of free movement of goods taking into account accession and Romania.

I. General provisions

1. The technical regulation about crystal glass (further - the Technical regulation) establishes requirements to classification, characteristics, marking and methods of determination of chemical and physical characteristics of categories of crystal glass.

2. This Technical regulation extends to products carried to line item 7013 Combined the commodity nomenclature approved by the Law No. 172/2014.

II. General requirements to provision in the market

3. Products from crystal glass can be provided in the market only if they correspond to this Technical regulation.

4. Each product from crystal glass, depending on the characteristics established in columns 3 - the 6th table given in appendix No. 1, shall be marked by the corresponding name provided in column 1 of the specified table.

5. Marking by the names specified in column 1 of the table given in appendix No. 1, of products from glass, foreign similar to products of crystal glass in case of lack at them of the characteristics established in columns 3 - 6 the specified tables is not allowed.

6. If from crystal glass be applied marking with the name specified in column 1 of the table given in appendix No. 1, on this product on product can the corresponding identification symbol specified and described in columns 7 and 8 of the table given in appendix No. 1 is put.

7. The name and identification symbol specified in the table given in appendix No. 1, can be applied on the same label.

8. If the trademark, the name of the producer or other text bears as the main part, adjective or root of the word the name specified in column 1 of the table given in appendix No. 1, or the name which can be confused with it then before the trademark, the name of the producer or any other text shall be specified:

1) the visible name of product if the product has the characteristics established in columns 3 - the 6th table given in appendix No. 1;

2) the accurate description of product if it has no the characteristics established in columns 3 - the 6th table given in appendix No. 1.

III. Supervision of the market

9. Supervision of the market and control of the products from crystal glass provided on the market are performed by the State inspectorate for supervision of non-food products and consumer protection according to the Law No. 162/2023 on supervision of the market and products compliance.

10. If the State inspectorate for supervision of non-food products and consumer protection determines that the product from crystal glass falling under action of this Technical regulation poses threat, it carries out assessment of this product taking into account all requirements established in Chapter II.

11. Evaluating, provided in Item 10, is based on test methods which are specified in appendix No. 2 and are carried out by the accredited test laboratories used for supervision of the market according to article 24 of the Law No. 162/2023 on supervision of the market and products compliance.

12. If during evaluating, the State inspectorate for supervision of non-food products and the consumer protection specified in Item 10, determines that the product from crystal glass does not conform to the requirements established in this Technical regulation, it takes adequate measures on prohibition or restriction of provision of product from crystal glass on the market or on withdrawal of product from the market.
