About approval of the Procurement procedure, the textbooks connected with production for the general education organizations of the Kyrgyz Republic

For the purpose of realization of Item 6 of part 4 of article 2 of the Law of the Kyrgyz Republic "About public procurements", according to articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:

1. Approve the Procurement procedure, the textbooks connected with production for the general education organizations of the Kyrgyz Republic, according to appendix.

2. Authorize Uchkun open joint stock company on production of textbooks for the general education organizations of the Kyrgyz Republic.

3. To the Ministry of Education and Science of the Kyrgyz Republic:

- bring the decisions into accord with this resolution;

- take other measures following from this resolution.

4. Declare invalid the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About approval of the Procedure of public procurements of goods and services in production of training materials for the educational organizations of the Kyrgyz Republic" of April 25, 2023 No. 222.

5. This resolution becomes effective after ten days from the date of official publication.

Procurement procedure, the textbooks connected with production for the general education organizations of the Kyrgyz Republic

Chapter 1. General provisions

1. This Procedure determines procurement procedure, the textbooks connected with production for the general education organizations of the Kyrgyz Republic.

2. The concepts used in this Procedure:

1) the buying organization - authorized state body in the fields of education, territorial subdivisions and subordinated organizations of authorized state body in the fields of education, the organization and organizations using for the purchases connected with production of textbooks for the general education organizations, means of local budgets and also the funds raised from lease of textbooks;

2) the guidelines manual - the edition including conceptual bases of the textbook or education guidance and recommendation for the teacher of the general education organization for technique of teaching subject, to planning, holding separate classes in subject or its Section and estimation of educational results of trainees, and also use of workbook and/or other components of educational and methodical complex;

3) the textbook - the multipurpose tutorial which contains the systematized statement of subject, its Section and part helps the teacher to organize activities of pupils in educational process and conforms to the existing State educational standard of the school general education of the Kyrgyz Republic and the existing subject standards;

4) the education guidance - the auxiliary educational edition supplementing or replacing the textbook, allowed to use in case of implementation of the training programs of the general education approved by authorized state body in the field of education;

5) educational and methodical complex - set of the educational and methodical materials developed on the single methodological basis according to state standards necessary and sufficient for the organization of training process in certain class. The educational and methodical complex surely includes the textbook (education guidance), workbook for the pupil and the guidelines manual for the teacher, and also can include other tutorials and control;

6) training materials - the textbooks, education guidances, guidelines manuals, educational and methodical complexes conforming to the existing State educational standard of the school general education of the Kyrgyz Republic and the existing subject standards, included in the List of the textbooks recommended for use in the general education organizations of the Kyrgyz Republic the current academic year.

Chapter 2. Procedure for holding procedure of the purchases connected with production of textbooks for the general education organizations of the Kyrgyz Republic

3. Purchases of services in production of training materials for the general education organizations of the Kyrgyz Republic (further - purchase of services) are performed by means of the conclusion of the contract with Uchkun open joint stock company (further - the Manufacturer).

4. The need for training materials for the general education organizations is determined by the buying organization based on official requests of the general education organizations, and also based on the decision of authorized state body in the field of education.

5. The price calculation on typographical services in production (replication) of training materials including obligatory payments of awards, expenses on publishing and typographical works, cost of consumable materials, and also expenses on delivery to destination of training materials is constituted by the Manufacturer and approved with authorized state body in the field of anti-monopoly regulation.

6. The contract of purchase of typographical services shall contain surely the technical specification on production (replication) of training materials, price calculation on typographical services, the plan of distribution of training materials, the delivery schedule of training materials to destination, methods and payment procedure, terms of provision of advance copies of training material and finished goods, and also other conditions by agreement of the parties.

7. The authorized state body in the field of education after the conclusion of the contract transfers to the Manufacturer electronic files of training materials on which property rights belong to authorized state body in the field of education.

8. The buying organizations using for purchase of services of means of local budgets and also the funds raised from lease of textbooks by means of the official address request from authorized state body in the field of education the list of training materials, production (replication) of which will be performed by the Manufacturer. The authorized state body in the field of education within three working days provides official reply to the request.
