About approval of the Procedure for forming of the weighted average rate for service in management of household waste, and also rates for collection, transportation, recovery and removal of household waste

According to parts one and the fourth article 34 of the Law of Ukraine "About waste management" the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for forming of the weighted average rate for service in management of household waste, and also rates for collection, transportation, recovery and removal of the added household waste.

2. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the enclosed list.

3. This resolution becomes effective from the date of its publication, except Items 8, 45-48 About, approved by this resolution which become effective since July 1, 2024.

Procedure for forming of the weighted average rate for service in management of household deviations, and also rates for collection, transportation, recovery and removal of household waste

General questions

1. This Procedure determines the mechanism of forming of the weighted average rate for service in management of household waste, and also rates for collection, transportation, recovery and removal of household waste.

This Procedure is applied by the subjects of managing providing service in management of the household waste (further - service) performing transactions on collection, transportation, recovery and removal of household waste (further - transactions), during forming of rate for service taking into account expenses of the administrator of service (in case of availability) and rates for transactions on cleaning, transportation (including in case of submission of documents on tender on implementation of collection and transportation of household waste), to recovery and removal of household waste, and also to change of such rates.

In case of the introduction of expanded liability of the producer of rather certain type of products and waste which are formed as a result of its consumption, and the conclusion of the relevant contracts between local government bodies and the organizations of expanded liability of the producer expenses on management of such waste do not join in rate for service if such waste gathers separately the organizations of expanded liability of the producer for preparation for reuse, recycling or other recovery.

Before establishment by the relevant law of expanded liability of the producer of rather certain type of products and the waste which are formed as a result of its consumption, and the conclusion of the relevant contracts between local government bodies and the organizations of expanded liability of the producer expenses on management of such waste join in rate for service in management of household waste.

2. The rate for service is the weighted average rate which is created on the basis of rates for transactions.

Expenses on administration of service are calculated separately according to this Procedure and join in the weighted average rate of the contractor of service.

Calculation of rate for service is perfromed by the contractor of service. Calculation of rates for transactions is perfromed by the subjects of managing performing the corresponding transactions.

Establishment of rates lower than the size of economically reasonable expenses on provision of the corresponding services is not allowed.

3. The terms used in this Procedure have the following value:

the basic period - the calendar year preceding the planned period;
