About approval of Rules of rendering services of mobile radio telephone communication

For the purpose of enhancement of the legislation in the field of communication, according to article 4 of the Law of the Kyrgyz Republic "About electric communication", articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:

1. Approve Rules of rendering services of mobile radio telephone communication according to appendix.

2. Provisions of this resolution and Rules of rendering services of mobile radio telephone communication approved by it extend to the legal relationship which arose after its introduction in action.

3. The information about subscribers containing in databases of the telecom operator, created in the course of the conclusion of service provision agreements of mobile radio telephone communication about day of entry into force of this resolution does not require reduction in compliance with provisions of this resolution and these service provision agreements of mobile radio telephone communication save the legal force.

4. Recognize invalid:

1) the order of the Government of the Kyrgyz Republic "About approval of Rules of rendering services of mobile radio telephone communication" of February 17, 2014 No. 97;

2) the order of the Government of the Kyrgyz Republic "About modification of the order of the Government of the Kyrgyz Republic "About approval of Rules of rendering services of mobile radio telephone communication" of February 17, 2014 No. 97" of January 15, 2018 No. 20.

5. This resolution becomes effective after six months from the date of official publication.

Rules of rendering services of mobile radio telephone communication

Chapter 1. General provisions

1. These rules of rendering services of mobile radio telephone communication (further - Rules) determine procedure for personification (registration) for subscribers and govern the relations arising between the telecom operator and the subscriber when rendering services of mobile radio telephone communication.

2. These rules do not extend to the relations connected with acquisition of the subscriber equipment and do not regulate contractual legal relationship between telecom operators and service providers or the third parties on provision of services, directory servicing, services of telematic services, data services and the services SMS informing (SMS mailing).

3. In these rules the following main terms and their determinations, including in the values established by the Law of the Kyrgyz Republic "About electric communication" are applied:

the subscriber - the physical person which successfully underwent the procedure of personification (registration) and signed with the telecom operator the service provision agreement of mobile radio telephone communication, the legal entity or the individual entrepreneur who signed with the telecom operator the service provision agreement of mobile radio telephone communication according to the procedure, established by these rules, with selection of one or more directory numbers;

directory number - number selected to the subscriber in use in case of the conclusion of the service provision agreement of mobile radio telephone communication for its action and identifying the exchange service stations connected to network of the telecom operator in case of connection with it of other exchange service stations;

the automated system of calculations (ASC) - the hardware-software complex including billing system, intended for automatic accomplishment of transactions of accounting of amount of the services received by the subscriber and their tariffing, and also payment for communication services;

analog of the sign manual - facsimile reproduction of the signature (facsimile), the digital signature, the signature reproduced with own hand on any device and also other types of analogs of the sign manual determined in the legislation of the Kyrgyz Republic;

billing information about the subscriber/user - information on the incoming, outgoing calls (date, time, connection duration), Sms (date, sending/obtaining time, the number of messages), service fee of communication and amount of data transmission;

the identity document - to identity documents, belong the passport of the citizen of the Kyrgyz Republic (ID card), the certificate of kayrylman, the passport of the foreign citizen, the certificate of the stateless person;

connection tariffing unit - unit of measure of time, quantity or information volume for which the payment equal to the rate established for connection of this type is levied from the subscriber/user;

single hot line - the permanent emergency field service created under the Ministry of emergency situations of the Kyrgyz Republic based on emergency field services of the ministries, administrative departments and local public administrations for the purpose of rapid response to addresses of citizens in emergency and unusual situations with single number of dialing;

zone of radio covering of network of the operator - the territory within which there is technical capability of provision of services confirmed with the operator;
