About modification of some regulations (realization of separate provisions of the Resolution of the Constitutional court on control of constitutionality of political party of "Blinders" No. 10/2023)
The Parliament adopts this organic law.
Art. I. - In the Electoral code No. 325/2022 (Official monitor of the Republic of Moldova, 2022, Art. No. 426-427, 770), with subsequent changes, to make the following changes:
1. Part (Article 16 to add 2) with Item e) the following content:
"e) persons which were at the time of removal the Constitutional court of the resolution on recognition of illegality of political party by members of executive body of political party, acknowledged unconstitutional and also persons holding elective offices from political party, acknowledged unconstitutional within five years from the date of pronouncement of the resolution of the Constitutional court.".
2. Part (Article 54 to state 7) in the following edition:
"(7) Violation of provisions of parts (5) and (6) this Article it is established by competent electoral authority, including with assistance of competent authorities and law enforcement agencies, and the amount which is received/used according to the specified parts is credited in the government budget based on the resolution of Central Election Commission. The administrative act of the relevant electoral organ about establishment of violations and depending on circumstances about application of the punishments prescribed by Items and), c) or e) parts (2) Articles 102, is brought to the attention of law enforcement agencies after its introduction in final force for attraction depending on circumstances to pravonarushitelny or criminal liability according to provisions of Articles 103 and 104.".
3. In the subitem the first Item f) parts (1) Article 68 of the word "Items c) and d) parts (2) Article 16;" shall be replaced with words "Items c) - е) parts (2) Article 16;".
4. In part (4) Article 70 the first offer to add with words ", and also attributes of the political parties recognized unconstitutional".
