Some questions of the omission and accounting of the humanitarian assistance in conditions of warlike situation
(Extraction)

The Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for the omission and accounting of the humanitarian assistance in conditions of warlike situation (further - the Procedure) which is applied.

2. Determine that for warlike situation:

provisions of resolutions of the Cabinet of Ministers of Ukraine of March 22, 2000 No. 544 "About the Procedure for customs clearance of loads of the humanitarian assistance" (The Official Bulletin of Ukraine, 2000, No. 12, the Art. 481) and of March 25, 2013 No. 241 "About approval of the Order of interaction central and local executive bodies and National Bank on implementation of the Law of Ukraine "About the humanitarian assistance" (The Official Bulletin of Ukraine, 2013, No. 29, Art. 990; 2016, 6, Art. 308) are not applied No. to goods which omission is performed according to Procedure;

recognition of goods the humanitarian assistance, the omission through customs border of Ukraine, customs clearance, obtaining, provision, distribution and control of target use of the humanitarian assistance specified in paragraph four of this Item is performed according to Procedure;

types of goods, imported on customs area of Ukraine according to Procedure, except those which do not belong to the humanitarian assistance according to the Law of Ukraine "About the humanitarian assistance" (except for oil products, the liquefied gas, substances used as components of motor fuels, fuel of motor alternative, ethyl alcohol for the medical purposes and pharmaceutical industry, electrical energy) are recognized the humanitarian assistance by the declarative principle without adoption of the relevant decision by specially authorized state bodies concerning the humanitarian assistance.

vehicles which are imported on customs area of Ukraine for needs of healthcare institutions of the state and utility patterns of ownership for ensuring medical attendance of the population are recognized the humanitarian assistance by the declarative principle according to Procedure, namely:

cars with engine displacement no more than 2000 cubic centimeters;

cars with engine displacement no more than 4200 cubic centimeters for needs of the centers of the emergency medical care and medicine of catastrophic crashes;

cars plug-in - hybrid and electric vehicles which cost does not exceed 190 sizes of the minimum wage established by the law for January 1 of year in which they are imported on customs area of Ukraine;

vehicles of special and specialized purpose (except taxi, collection cars).

2-1. Establish till April 1, 2024 transition period for the omission through customs border of Ukraine of the humanitarian assistance performed according to procedure during which the omission through customs border of Ukraine of the humanitarian assistance can be performed also in the place of crossing of customs border of Ukraine by submission in paper form of the declaration of goods, recognized by the humanitarian assistance filled with person transporting the corresponding goods in form according to appendix 1 to the Procedure without specifying of unique code of the humanitarian assistance which is provided by the automated system of registration of the humanitarian assistance (the omission of goods without use of the automated system of registration of the humanitarian assistance).

Goods which omission is performed without use of the automated system of registration of the humanitarian assistance are recognized the humanitarian assistance by the declarative principle without adoption of the relevant decision of specially authorized state bodies concerning the humanitarian assistance (the humanitarian assistance imported without use of the automated system of registration of the humanitarian assistance).

At the same time Items 4, 6-14, 17 of the Procedure are not applied. The receiver of the humanitarian assistance imported without use of the automated system of registration of the humanitarian assistance till March 31, 2024 loads into the specified system the copy of the paper report on distribution and use of the humanitarian assistance in form according to appendix 3 to the Procedure (further - the report) signed by the head or person responsible for conducting financial accounting, or the copy of the report electronically with imposing of the qualified digital signature of the head or person responsible for conducting financial accounting.

The humanitarian assistance imported without use of the automated system of registration of the humanitarian assistance concerning which the report till March 31, 2024 is not loaded is considered such concerning which there is no accounting on its obtaining and target use, and used not for purpose.

2-2. The omission through customs border and customs clearance of the humanitarian assistance in type of vehicles for persons determined according to part two of article 6 of the Law of Ukraine "About the humanitarian assistance" is performed without written confirmation from such persons. Target use of such vehicles is confirmed by the report on availability and distribution of the humanitarian assistance provided according to procedure.

3. Bring in the resolution of the Cabinet of Ministers of Ukraine of April 28, 2000 No. 728 "About approval of the Procedure for export out of limits of Ukraine or destruction of goods (objects) of the humanitarian assistance, low-quality and unsuitable to consumption" (The Official Bulletin of Ukraine, 2000, No. 18, Art. 741; 2013, No. 29, the Art. 1007) the enclosed changes.

4. Recognize invalid resolutions of the Cabinet of Ministers of Ukraine according to the enclosed list.

5. To provide to the State Customs Service and Administration of the State Border Service for warlike situation the urgent omission through frontier of the humanitarian assistance.

6. Provide to the Ministry of Foreign Affairs the organization of work of diplomatic organizations abroad on coordination of work of the logistic centers of provision of the humanitarian assistance to Ukraine in adoptive state.

7. This resolution becomes effective since December 1, 2023, except:

Item 3 of this resolution which becomes effective from the date of publication of this resolution;

paragraph two of Item 10 and the paragraph of the sixth Item 12 of the Procedure approved by this resolution which become effective in three months from the date of entry into force of this resolution.
