About interpretation of articles 45-49 and 51 of the Law on activities of banks No. 202/2017

Based on Item c) article 66 of the Constitution of the Republic of Moldova and part (2) article 72 of the Law on regulations No. 100/2017

The parliament adopts this organic law.

Art. I. - In sense of articles 45-49 and 51 of the Law on activities of banks No. 202/2017 (The official monitor of the Republic of Moldova, 2017, Art. No. 434-439, 727), with subsequent changes, interpretation of the phrases concerning acquisition and receipt of ownerships in the capital of bank covers also situations when shareholders of bank solve is approved to exercise the rights connected with already belonging ownerships so that to form essential ownership in the authorized capital of bank or ownership which corresponds or exceeds 5, 10, 20, 33 either 50 percent of the capital of bank or proportion of their implementable it is approved voting powers in the capital of bank corresponded or exceeded 1, 5, 10, 20, 33 or 50 percent or so that the bank became their affiliated enterprise.

Art. II. - This law is applied also to the situations connected with acquisition/obtaining and increase in ownerships including by the coordinated actions concerning the ownerships which are already in the capital of banks by means of any transaction or legal act which are implemented or are in implementation process on the date of entry into force of this law.
