RESOLUTION OF THE PRESIDENT OF THE REPUBLIC OF UZBEKISTAN

About measures for further enhancement of system of public administration in the field of town-planning activities and to approval of programs of development of town-planning documentation of settlements in 2023 - 2027

For the purpose of ensuring implementation of the State program on strategy implementation of development of New Uzbekistan for 2022 - 2026 in "Year of ensuring interests of the person and development waved", the Republic of Uzbekistan approved by the Presidential decree of January 28, 2022 No. UP-60, of Strategy of upgrade accelerated and innovative development of building sector of the Republic of Uzbekistan for 2021 - 2025 approved by the Presidential decree of the Republic of Uzbekistan of November 27, 2020 No. UP-6119, and also enhancement of system of development of town-planning documentation of the territories and settlements:

1. Establish the following levels of the developed documents on town-planning planning of the territories:

at the first level are developed the General scheme of the layout of development of the territory of the Republic of Uzbekistan (further - the General scheme) determining competitive advantages of regions and drivers of sustainable development, the scheme of the layout of development of the territories of the Republic of Karakalpakstan and areas (further - territorial schemes), and also the Strategy of development of agglomerations on the basis of integration of the cities (settlements) and residential suburbs;

at the second level master plans of the cities (settlements) (further - master plans of the cities) on the basis of integration of the cities (settlements) and residential suburbs, and also the scheme of town-planning development of the territories of rural settlements are developed (further - schemes of rural settlements);

at the third level the master plans or drafts of the detailed layout including the town-planning, social and economic, ecological and other project decisions directed to elimination of specific problems of the territories are developed.

Approve degrees of scope of the territories of settlements by town-planning documentation according to appendix No. 1*.

2. Determine that:

The republican architectural town-planning council under the Cabinet of Ministers is the coordinating body for establishing interaction of the ministries, departments and khokimiyats by spheres and industries in case of development of the General scheme, territorial schemes, strategies of development of agglomerations, master plans of the cities and schemes of rural settlements;

The Ministry of Economics and finance is responsible body for determination of the directions of long-term development and forecast parameters within development of town-planning documentation of settlements;

The Ministry of Construction and Housing and Communal Services is responsible body for development of the General scheme, territorial schemes and strategies of development of agglomerations, master plans of the cities and schemes of rural settlements;

The Council of Ministers of the Republic of Karakalpakstan, khokimiyats of areas and the city of Tashkent, and also the interested ministries and departments are customers on development of master plans and drafts of the detailed layout.

In case of development of master plans and drafts of the detailed layout private initiators are allowed to perform functions of the customer.

3. Determine that:

a) The general scheme is recognized the multi-purpose strategic document of nation-wide value in the territory of the Republic of Uzbekistan in the following directions:

ensuring state regulation of system of resettlement of the population and production forces;

identification of actual state of the territories, potential, determination of the purposes and features of coherence;

coordination of interterritorial and cross-industry state interests within programs of social and economic development by implementation of architectural, town-planning and construction activities;

determination of town-planning documentation of settlements as basis for development of design assignment;

b) project decisions in the General scheme and territorial schemes are developed counting upon long-term outlook taking into account the Strategy of development for the Republic of Uzbekistan, and also the international and regional integration processes, territorial programs of neighboring states for social and economic development and world tendencies;

c) approval and determination of the priority directions on regular (each 3 - 5 years) to enhancement of the General scheme and territorial schemes are performed by the Cabinet of Ministers.

4. Resolve development of master plans of the cities in the simplified format according to design assignment of the Ministry of Construction and Housing and Communal Services. At the same time based on the data represented by local executive bodies, the relevant ministries and departments, the territories of settlements are divided into the following zones:

a) preservation zones. These zones include green zones, the coastal and roadside territories, objects of cultural heritage, the social sphere, military camps and objects of special category and their protected territories, and also historically developed part of the settlement with the requirement of preserving them in original state;

b) zones of reconstruction and renovation. In these zones are determined only:

functional zones according to the purposes of use of the territory with establishment of restrictions for their use;

density parameters determining ratio of the permitted house area of the building or construction to the area of the parcel of land of this building or construction;

capacity and directions of the high-level engineering networks;

arrangement of the green plantings of the territories which are available and planned to landing;

grade red lines.

5. For the purpose of implementation of town-planning and business activity, planning of territorial and economic development of parts of the territories for the near-term, medium and long-term outlook and realization of their economic potential to implement system of development of the master plans reflecting in themselves the specific solution of the existing problems and mechanisms of its realization. At the same time:

a) development of master plans in cases is allowed:

discrepancies of plans and proposals of the customer on development of the territory of town-planning documentation on development planning and building of this territory, including insufficient use of natural and economic potential of the territory, and also determination of exposure to auction of the free parcel of land based on the master plan;

lack of town-planning documentation of the territory;

b) the master plan developed together with the draft of the detailed layout, the project of building and design code of this territory, and approved in accordance with the established procedure is accepted as the town-planning document;

c) approval of the master plan developed as the town-planning document is performed by the state body authorized on approval of town-planning documentation of this territory;

d) in the course of preparation of offers on change of category of land fund of lands of agricultural purpose for the town-planning purposes development of master plans of these territories is performed without fail.
