About modification of some Orders of the Government (review of the regulatory base of the mode of weapon and ammunition of civil appointment)

Based on Item b) Articles 5, Items c) and h) article 6 of the Law No. 136/2017 on the Government (The official monitor of the Republic of Moldova, 2017, No. 252, the Art. 412), with subsequent changes, DECIDES: the Government

1. In the Regulations on the mode of weapon and ammunition of civil appointment approved by the Order of the Government No. 293/2014 (The official monitor of the Republic of Moldova, 2014, Art. No. 104-109, 324) to make the following changes:

1) in all text:

a) words "Ministry of Public Education" in any grammatical form shall be replaced with words "authorized central industry body in the field of education" in the corresponding grammatical form;

b) "The law No. 793-XIV from on February 10, 2000 about administrative court" in any grammatical form to replace the text with the text "The administrative code of the Republic of Moldova No. 116/2018" in the corresponding grammatical form;

Item 6 to add 2) with the subitem 20) of the following content:

"20) the instructor of shooting shooting gallery - the person who received the certificate of the instructor of shooting shooting gallery according to the law and performing activities for training, manual and supervision of the firing practice which is carried out in the authorized shooting galleries.";

3) in Item 7:

6) to declare the subitem invalid;

9) to state the subitem in the following edition:

"9) the certificate of the member of the national or international specialized organizations for sports firing or the testimonial of the trainer on firing valid according to the Law No. 330/1999 on physical culture and sport, in the original and in copies, and also the reference/statement, issued by the specialized organization for sports firing to which person belongs, confirming its consent to use of weapon at trainings or official tenders in which it shall participate, on small arms of category of long-barreled weapon - on circumstances;";

c) add with subitems 9-1) and 9-2) of the following content:

"9-1) valid certificate of the collector, in the original and in the copy, in case of weapon of collection appointment on which person can request only provision of right of possession;

9-2) in departure from subitem provisions 4) the staff of the bodies provided in Item b) parts (1) article 7 of the Law, can prove it by presentation of the certificate of the veteran of data of bodies, except for case when they lost the status for the reasons depending on them;";

10) to state the subitem in the following edition:

"10) the written declaration under the personal liability that person has the metal safe attached to floor or wall and also conditions for safety and integrity of weapon and ammunition which example is provided in

appendix No. 46";

Item 8 to state 4) in the following edition:

"8. Originals of the documents provided in subitems of 3)-5) and 8) Item 7, presented and in the form of copies, return on site after reconciliation of copies with them, on circumstances.";

5) in Item 9 the text "in Items c) - е) parts (Article 7" to replace 1) with the text "in Items b) and d) parts (1) Article 7";

The text "without the need for presentation of other documents" to replace 6) in Item 10 with the text "without the need for the proof of accomplishment of the conditions provided in subitems 2), 4), 6) and 8)-11) of Item 7, on circumstances";

The text "the subitem 11)" to exclude 7) in Item 13, and to replace the word of "Item" with the word "Item";

To state Item 14 in the following edition:

"14. In the situation provided in Item 13, the term of the consideration of the application provided in Item 11, stops from date when requirement about submission of additional / related documents and information, before date of accomplishment of this requirement by it was imposed on this person. The term of suspension cannot exceed 90 days, after this term the statement is subject to variation.";

To add 9) with Items 41-1-41-3 of the following content:

"41-1. If the owner of right of possession, carrying and use of weapon make its alienation through the armorers having the license for sale of this kind of weapon, he shall give to authorized service of the General inspectorate of police or, on circumstances, in case of smooth-bore weapon - in authorized service of the Inspectorate of police in the place of the residence the standard statement which sample is provided in appendix No. 40, to which the identification document and the weapons permit, in the original and in the copy, for issue of permission to alienation which model is provided in appendix No. 41 is attached.
