About purchases of goods (works, services) at the expense of own means

Based on subitem 11.4 of Item 11 of the Regulations on Administration of the President of the Republic of Belarus approved by the Presidential decree of the Republic of Belarus of December 3, 2010 No. 620, of Item 5-3 of the resolution of Council of Ministers of the Republic of Belarus of March 15, 2012 No. 229 "About enhancement of the relations in the field of purchases of goods (works, services) at the expense of own means" Administration of the President of the Republic of Belarus DECIDES:

1. Determine that:

1.1. the organizations subordinated to Administration of the President of the Republic of Belarus economic societies in which authorized capitals more than 25 percent of shares (shares) belong to the Republic of Belarus and is in management (operational management) of the specified organizations, and also in management (operational management) of Administration of the President of the Republic of Belarus, located in the territory of the Republic of Belarus, Department on humanitarian activities of Administration of the President of the Republic of Belarus (further, unless otherwise specified, - the organizations of Administration) conduct procurement, except for public procurements, goods (works, services) (further - purchases through own means) according to the resolution of Council of Ministers of the Republic of Belarus of March 15, 2012 No. 229 taking into account the features established by this resolution if other is not determined by legal acts;

1.2. when implementing purchases at the expense of own funds for the amount more than 100 basic sizes according to one transaction on acceptance date by the organizations of Administration of the decision on purchase execution irrespective of type of the chosen procedure studying of market situation by the organizations of Administration is obligatory.

Studying of market situation is carried out by means of:

studying of the price information on goods (works, services) containing including in price lists of current prices (rates) for goods (works, services), price lists, and also information placed by potential suppliers (contractors, contractors) on their official sites on the global computer Internet, electronic trading platforms;

the directions of requests about provision of data we rub at least (in case of their availability) to potential suppliers (contractors, contractors), information on which is available in open access on the global computer Internet. At the same time the direction of such requests to domestic manufacturers (is obligatory in case of their availability) and their sales organizations (official sales representatives), and also the organizations of Administration - potential suppliers (contractors, contractors).

The requests about provision of data specified in paragraph three of part two of this subitem go to potential suppliers (contractors, contractors) in case of lack of price information to the goods offered by them (works, services) on their official sites on the global computer Internet, electronic trading platforms, and also can be placed on one of electronic trading platforms.

Requirements to content of requests about provision of data, the specified in paragraph three of part two, part three of this subitem, method of their direction to potential suppliers (contractors, contractors), procedure for generalization of price information on goods (works, services), document storage (data) confirming studying of market situation are determined by the organizations of Administration in the procurement procedure of goods (works, services) approved by them at the expense of own means;

1.3. purchases at the expense of own funds for the amount up to 1000 basic sizes according to one transaction on acceptance date by the organizations of Administration of the decision on purchase execution (except for purchases of auditor services in carrying out statutory audit of the annual accounting and (or) financial reporting) if the purchased goods (works, services) make (carry out, render) the organizations of Administration, can be performed at such organizations without application of procedures of purchases and without studying of market situation provided by subitem 1.2 of this Item;

1.4. the organizations of Administration conduct procurement of goods (works, services), except the purchases specified in subitem 1.3 of this Item, with the obligatory invitation to participation in procedure for procurement of the organizations of Administration performing production of such goods (works, services);

1.5. in case of agreement performance on purchase at the expense of own means by the organizations of Administration allow increase in amount (quantity) in subject of purchase, but no more than for 15 percent in relation to the amount (quantity) of the corresponding goods (works, services) provided by the agreement in case of its conclusion.

In case of need for acquisition of additional amount (quantity) of goods (works, services) exceeding more than for 15 percent I will eat around (quantity) of the corresponding goods (works, services), provided by the agreement in case of its conclusion, the organizations of Administration perform holding new procedure for procurement of goods (works, services);

1.6. in case of centralization of purchases of goods (works, services) at the expense of own means in "Agro-industrial Holding of Administration of the President of the Republic of Belarus" holding the organizer of procedures of centralized purchases is the republican unitary enterprise "Managing company of "Agro-industrial Holding of Administration of the President of the Republic of Belarus" holding.

2. Declare invalid the resolution of Administration of the President of the Republic of Belarus of August 26, 2019 No. 4 "About purchases of goods (works, services) at the expense of own means".

3. This resolution becomes effective after its official publication.
