Some questions of automatic check (verification) of data means of the Single state web portal of electronic services with use of data from the Unified state demographic register, the State register of physical persons taxpayers

According to part five of article 6 of the Law of Ukraine "About state registration of legal entities, physical persons - entrepreneurs and public forming" the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for automatic check (verification) for data by means of the Single state web portal of electronic services with use of data from the Unified state demographic register, the enclosed State register of physical persons - taxpayers.

2. Determine that automatic verification (verification) of information about person who is final beneficial owner of the legal entity means of the Single state web portal of electronic services with use of data from the Unified state demographic register, the State register of physical persons - taxpayers is carried out to time of state registration:

1) formation of limited liability company, the acting on the basis of the model charter of limited liability company;

2) formation of legal entity (except limited liability company, the acting on the basis of the model charter of limited liability company) and modification of the information about the legal entity containing in the Unified State Register of Legal Entities, physical persons - entrepreneurs and public forming, after ensuring technical capability of realization of such state registration with means of the Single state web portal of electronic services.

Procedure for automatic check (verification) for data means of the Single state web portal of electronic services with use of data from the Unified state demographic register, the state register of physical persons taxpayers

1. This Procedure determines the mechanism of automatic check (verification) of information about person who is final beneficial owner of the legal entity, in case of state registration of formation of legal entity and modification of the information about the legal entity containing in the Unified State Register of Legal Entities, physical persons - entrepreneurs and public forming, means of the Single state web portal of electronic services (further - the Action Portal) with use of data from the Unified state demographic register, the State register of physical persons - taxpayers.

3. In case of filing of application for state registration of formation of legal entity and modification of the information about the legal entity containing in the Unified State Register of Legal Entities, physical persons entrepreneurs and public forming (further - the statement), are checked by means of the Action Portal such information about the final beneficial owner of the legal entity (is verified):

surname, own name, middle name (in the presence);

birth date;

document type, series (in the presence) and document number, the passport of the citizen of Ukraine proving the identity and confirming nationality (citizenship), in particular for trip abroad;

unique number of entry in the Unified state demographic register;

place of residence;

registration number of accounting card of the taxpayer (in the presence).

4. Are checked by means of the Action Portal (are verified) by electronic information exchange:

with the Unified state demographic register through unified information system of the Ministry of Internal Affairs - data on surname, own name, middle name (in the presence); birth date; document type; series (in the presence) and document number, the passport of the citizen of Ukraine proving the identity and confirming nationality (citizenship), in particular for trip abroad; unique number of entry in the Unified state demographic register; residence;

with the State register of physical persons-taxpayers-data about registration number of accounting card of the taxpayer.

5. By results of conducting automatic check (verification) of the data containing in the statement, the software of the Unified state demographic register through unified information system of the Ministry of Internal Affairs and the State register of physical persons - taxpayers go to the portal action of the notification on results of conducting such check (verification).

In case of establishment by results of the carried-out automatic inspection (verification) of discrepancy of the information about the final beneficial owner of the legal entity specified in the statement to the data containing in information systems (information and communication systems) forming of the statement means of the Portal is terminated and its representation is blocked.

6. Processing of personal data is performed with observance of requirements of the legislation in the sphere of personal data protection.

7. The electronic information exchange provided by this Procedure is performed with use of means of system of electronic interaction of the state electronic information Trembita resources with compliance with laws of Ukraine "About electronic confidential services", "About personal data protection", "About public electronic registers", "About information security in information and communication systems".

In case of lack of technical capability of data transmission with use of system of electronic interaction of the state electronic information Trembita resources electronic information exchange of subjects of electronic interaction can be performed with use of other information and communication systems using in them the corresponding complex systems of information security with the confirmed compliance by results of state examination according to the procedure, established by the legislation.

The amount and structure of data which subjects of electronic information exchange via program interfaces of electronic information resources exchange (services) are determined by the agreements on information exchange signed according to procedure electronic (technical and information) the interaction approved by the resolution of the Cabinet of Ministers of Ukraine of September 8, 2016 No. 606 "Some questions of electronic interaction of electronic information resources" (The Official Bulletin of Ukraine, 2016, No. 73, Art. 2455; 2021, No. 52, Art. 3216; 2023, No. 11, Art. 721).
