About implementation of the Law of the Republic of Belarus of October 10, 2022 No. 208-Z "On regulation of safety when using atomic energy"

(In edition of Resolutions of Council of Ministers of the Republic of Belarus of 08.08.2025 No. 425, 29.12.2025 No. 787)

Based on paragraphs of the seventh or tenth of Article 9, 22, Article parts two 25, Article parts four 26, Article parts four 31, Article parts two 34, Article parts seven 43, Article parts one 48, Article parts two 53, of parts three and the fifth Article 57, Article parts two 58, Article parts two 63, of paragraph two of article 72 of the Law of the Republic of Belarus of October 10, 2022 No. 208-Z "On regulation of safety when using atomic energy" the Council of Ministers of the Republic of Belarus DECIDES: Article parts two

1. Approve:

The disciplinary charter of employees of the operating organizations (is attached);

The regulations on the safety area with particular legal regime in the territory, adjacent to the Belarusian nuclear power plant, (are applied);

The regulations on the safety area with particular legal regime within borders of the public scientific institution "The Joint Institute of Energy and Nuclear Researches — Pines" of National academy of Sciences of Belarus (are applied);

The regulations on procedure for ensuring physical nuclear safety (are applied);

The regulations on procedure for the organization and maintaining the state system of accounting and control of nuclear materials (are applied);

The regulations on procedure for functioning of the state system of guarantees (are applied);

The regulations on procedure for plan development of actions for protection of the population against nuclear and radiation accident (are applied);

The regulations on procedure for forming and functioning of system of scientific and technical support to the regulating activities in the field of ensuring nuclear and radiation safety (are applied);

The regulations on features of assessment of conformity of products for which technical requirements in the field of safety when using atomic energy are established of processes of its development, designing, researches, productions, constructions, installation, adjustment, operation (use), storage, transportation (transportation), realization, utilization and burial (are applied);

The regulations on the National commission on safe use of atomic energy under Council of Ministers of the Republic of Belarus (are applied).

Regulations on procedure for approval, establishment and designation of borders of the sanitary protection zone, zone of observation of nuclear installation and (or) Item of storage, Item of burial and the requirement for their protection and use (are applied).

2. Determine:

the list of products which are subject to assessment of conformity for which technical requirements in the field of safety when using atomic energy, processes of its development, designing, researches, productions, constructions, installation, adjustment, operation (use), storage, transportation (transportation), realization, utilization and burial, according to appendix 1 are established;

the list of products which are subject to obligatory certification for which technical requirements in the field of safety when using atomic energy, processes of its development, designing, researches, productions, constructions, installation, adjustment, operation (use), storage, transportation (transportation), realization, utilization and burial, according to appendix 2 are established;

the safety area with particular legal regime in the territory, adjacent to the Belarusian nuclear power plant, according to the scheme according to appendix 3 in borders of the highways P-45, P-52, H-6211, H-6223, N-20110 with inclusion of settlements of Avena, Shulniki, Novodrozhki, Valeykuna and Grodi in administrative borders, and also in the territory with a radius of 300 meters around the station of water intake and complex of constructions of technical water supply with pumping point of the first rise and water reception ladle, pumping point of the second rise with reservoirs of the Belarusian nuclear power plant and taking into account borders of this safety area according to appendix 4. At the same time safety area borders with particular legal regime do not include highways, except for the section of the highway N-6223 according to appendix 3;

the safety area with particular legal regime within borders of the public scientific institution "The Joint Institute of Energy and Nuclear Researches — Pines" of National academy of Sciences of Belarus according to the scheme according to appendix 5 and taking into account its border according to appendix 6;

structure of the National commission on safe use of atomic energy under Council of Ministers of the Republic of Belarus according to appendix 7;

the list of the bodies of state regulation in the field of safety when using atomic energy performing approval of programs of commissioning of nuclear installation and (or) Item of storage, Item of burial and prolongation of term of their operation according to appendix 8;

the description of the warning sign designating safety area borders with particular legal regime of the republican unitary enterprise "Belarusian Nuclear Power Plant" according to appendix 8-1;

the description of the warning sign designating safety area borders with particular legal regime of the public scientific institution "The Joint Institute of Energy and Nuclear Researches — Pines" of National academy of Sciences of Belarus according to appendix 8-2;

the image of the warning sign designating safety area borders with particular legal regime of the republican unitary enterprise "Belarusian Nuclear Power Plant" according to appendix 8-3;

the image of the warning sign designating safety area borders with particular legal regime of the public scientific institution "The Joint Institute of Energy and Nuclear Researches — Pines" of National academy of Sciences of Belarus according to appendix 8-4.

3. Determine that:

3.1. documents on assessment of conformity of products for which technical requirements in the field of safety when using atomic energy, processes of its development, designing, researches are established of production, constructions, installation, adjustment, operation (use), storage, transportation (transportation), realization, utilization and burial (further if other is not established, – assessment of conformity in the field of use of atomic energy) *, issued before entry into force of the paragraph of the tenth Item 1 and paragraphs two and third Item 2 of this resolution, are valid before the termination of term of their action;

* For the purposes of this resolution documents on assessment of conformity in the field of use of atomic energy are understood as the documents confirming compliance of products, processes of its development, designing, researches, productions, constructions, installation, the adjustments, operation (use), storage, transportation (transportation), realization, utilization and burial to technical requirements in the field of safety when using atomic energy including issued according to the legislation of the supplying country of the project of subject to use of atomic energy (in the cases provided by this resolution).

3.2. as the documents on assessment of conformity in the field of use of atomic energy confirming compliance to products made outside the Republic of Belarus for which technical requirements in the field of safety when using atomic energy, processes of its development, designing, researches are established productions, constructions, installation, adjustment, operation (use), storage, transportation (transportation), realization, utilization and burial (further if other is not established, – products), and also products made in the Republic of Belarus (in the cases provided by Regulations on features of assessment of conformity of products for which technical requirements in the field of safety when using atomic energy, processes of its development, designing, researches, productions, constructions, installation, adjustment, operation (use), storage are established transportations (transportation), realization, utilizations and burials, the approved this resolution), can be applied the documents issued according to the legislation on assessment of conformity in the field of use of atomic energy of the supplying country of the project of subject to use atomic энергии*.

Application of the documents specified in part one of this subitem is determined according to this resolution and rules of assessment of conformity of use of atomic energy specified in Item 15 of the Regulations on features of assessment of conformity of products for which technical requirements in the field of safety when using atomic energy, processes of its development, designing, researches, productions, constructions, installation, adjustment, operation (use), storage, transportation (transportation), realization, utilization and the burial approved by this resolution are established.

* For the purposes of this resolution the supplying country of the project of subject to use of atomic energy is understood as the country with which the international treaty concerning construction, including designings, subject to use of atomic energy is signed.

4. Make changes to resolutions of Council of Ministers of the Republic of Belarus according to appendix 9.

5. Recognize invalid resolutions of Council of Ministers of the Republic of Belarus according to appendix 10.

6. To Department of Energy till January 1, 2025:

in coordination with the State committee on standardization, the Ministry of Emergency Situations, National academy of Sciences of Belarus to determine from structure of products specified in appendix 2, the list of products for which carrying out certification will (be perhaps reasonable) the certification bodies accredited in the National accreditation system of the Republic of Belarus;

together with the Ministry of Emergency Situations and National academy of Sciences to establish technical requirements in the field of safety when using atomic energy to products determined within execution of paragraph two of this Item.

7. To the state committee on standardization, the Ministry of Emergency Situations, the Department of Energy and National academy of Sciences of Belarus in case of determination of the list of products and technical requirements to it according to Item 6 of this resolution till July 1, 2025 to introduce in Council of Ministers of the Republic of Belarus offers on terms of carrying out certification of the specified products on compliance to technical requirements in the field of safety when using atomic energy within National system of confirmation of conformity of the Republic of Belarus.

8. To republican state bodies, regional executive committees, the Minsk Gorispolkom in three-months time to bring the regulatory legal acts into accord with this resolution and to take other measures for its realization.

9. This resolution becomes effective in the following procedure:

the paragraph the tenth Item 1, paragraphs two and third Item 2 concerning assessment of conformity in the field of use of atomic energy of products delivered on the Belarusian nuclear power plant, processes of its development, designing, researches, production, construction, installation, adjustment, operation (use), storage, transportation (transportation), realization, utilization and burial – from the first following after month of input of the Belarusian nuclear power plant in operation;

the paragraph the fourth Item 5 of the Regulations on features of assessment of conformity of products for which technical requirements in the field of safety when using atomic energy, processes of its development, designing, researches are established, production, construction, installation, adjustment, operation (use), storage, transportation (transportation), realization, utilization and the burial approved by this resolution – since January 1, 2025;

paragraphs the fourth or twelfth Item 2, the paragraph the fourth Item 8 and paragraphs the twelfth and thirteenth Item 9 of appendix 9 – after official publication of this resolution;

other provisions of this resolution – since October 14, 2023.

Appendix 1

The list of products which are subject to assessment of conformity for which technical requirements in the field of safety when using atomic energy, processes of its development, designing, researches, productions, constructions, installation, adjustment, operation (use), storage, transportation (transportation), realization, utilization and burial are established

1. The products applied on subject to use of atomic energy as elements of subject to use of atomic energy, carried according to regulations and rules on ensuring nuclear and radiation safety to 1–3 classes of safety, except for nuclear materials and spent nuclear fuel.

2. The fuel elements and assemblies, including the working cartridges, regulating authorities of management systems and protection applied in active zones of reactors of nuclear power plants.

3. The hoisting cranes carried according to regulations and rules on ensuring nuclear and radiation safety to groups A, B and B and used on subjects to use of atomic energy.

4. The components, welding and naplavochny materials, semifinished products applied as a part of products (products components) specified in Items 1 and 3 of this list.

5. The components, welding and naplavochny materials, semifinished products applied as a part of products (products components) specified in Item 2 of this list.

6. 4 classes of safety which are specially designed for application in the field of use of atomic energy:

steam and boilers with the working excessive pressure of couple over 0,07 of MPa and with the water temperature over 115 °C;

pipelines of vapor and hot water with the working excessive pressure of couple over 0,07 of MPa and with the water temperature over 115 °C;

the vessels working under the excessive pressure of water vapor or gas over 0,07 of MPa and with the water temperature over 115 °C.

7. Products specified in Item 1 of this list which concern to groups A, B and C.
