About introduction of the tariff quota on export out of limits of the territory of the Russian Federation of waste and scrap of ferrous metals to the states which are not members of the Eurasian Economic Union and modification of rates of the export customs duties on the goods exported from the Russian Federation out of limits of customs area of the Eurasian Economic Union

1. Establish from July 1 to December 31, 2023 inclusive the tariff quota on export out of limits of the territory of the Russian Federation to the states which are not members of the Eurasian Economic Union, waste and scrap of ferrous metals (codes of the CN FEA EEU 7204 10 000 0, 7204 30 000 0, 7204 41 100 0, 7204 41 910 0, 7204 41 990 0, 7204 49 100 0, 7204 49 300 0, 7204 49 900 0 and 7204 50 000 0) who are exported according to customs procedure of export in the total volume of 600000 tons (further respectively - waste and scrap of ferrous metals, the tariff quota).

2. Approve enclosed:

Rules for apportionment between participants of foreign trade activity of the tariff quota concerning waste and scrap of the ferrous metals which are taken out out of limits of the territory of the Russian Federation to the states which are not members of the Eurasian Economic Union according to customs procedure of export (further - Rules);

 changes which are made to rates of export customs duties on the goods exported from the Russian Federation out of the limits of customs area of the Eurasian Economic Union approved by the order of the Government of the Russian Federation of November 27, 2021 No. 2068 "About rates of export customs duties on the goods exported from the Russian Federation out of limits of customs area of the Eurasian Economic Union" (The Russian Federation Code, 2021, No. 49, Art. 8255; 2022, No. 23, Art. 3800; No. 32, Art. 5834; 2023, No. 1, Art. 299).

3. To the Federal Customs Service from the date of official publication of this resolution to submit within 3-day term within the Ministry of Industry and Trade of the Russian Federation data of customs statistics on the participants of foreign trade activity who performed from January 1, 2021 to December 31, 2022 (inclusive) export out of limits of the territory of the Russian Federation to the states which are not members of the Eurasian Economic Union, waste and scrap of ferrous metals with indication of for each participant of foreign trade activity of data on amounts of waste and scrap of the ferrous metals which are taken out by it to this period through the specific check point through frontier of the Russian Federation.

4. To the Ministry of Industry and Trade of the Russian Federation:

a) distribute between participants of foreign trade activity amount of the tariff quota concerning waste and scrap of ferrous metals according to Rules;

b) perform issue to participants of foreign trade activity of one-time licenses for export from the territory of the Russian Federation to the states which are not members of the Eurasian Economic Union, waste and scrap of ferrous metals within the amount of the tariff quota distributed according to Rules.

5. Realization of the powers established according to this resolution is performed within the number of workers of the corresponding federal executive bodies and budgetary appropriations of the federal budget provided by it on management and management in the field of the established functions established by the Government of the limiting Russian Federation.

6. This resolution becomes effective from the date of its official publication, except for Item 1 and the paragraph of third Item 2 of this resolution which become effective since July 1, 2023.

1. These rules determine procedure for distribution between participants of foreign trade activity of the tariff quota to export out of limits of the territory of the Russian Federation to the states which are not members of the Eurasian Economic Union, waste and scrap of ferrous metals (codes of the CN FEA EEU 7204 10 000 0, 7204 30 000 0, 7204 41 100 0, 7204 41 910 0, 7204 41 990 0, 7204 49 100 0, 7204 49 300 0, 7204 49 900 0 and 7204 50 000 0) (further - waste and scrap of ferrous metals) according to customs procedure of export (further - the tariff quota).

2. The amount of the tariff quota is distributed by the Ministry of Industry and Trade of the Russian Federation concerning waste and scrap of the ferrous metals which are taken out out of limits of the territory of the Russian Federation to the states which are not members of the Eurasian Economic Union according to customs procedure of export between participants of foreign trade activity based on the data of customs statistics provided by the Federal Customs Service according to Item 3 of the order of the Government of the Russian Federation of June 30, 2023 to No. 1086 "About introduction of the tariff quota on export out of limits of the territory of the Russian Federation of waste and scrap of ferrous metals to the states which are not members of the Eurasian Economic Union and modification of rates of the export customs duties on the goods exported from the Russian Federation out of limits of customs area of the Eurasian Economic Union" (further - the order of the Government of the Russian Federation).

3. Distribution between participants of foreign trade activity of 80 percent of amount of the tariff quota, the stipulated in Item 1 order of the Government of the Russian Federation, is performed by the Ministry of Industry and Trade of the Russian Federation till July 3, 2023 (inclusive) in proportion to the indicators calculated for each participant of foreign trade activity by addition of the amounts of waste and scrap of the ferrous metals increased by coefficients for check points through frontier of the Russian Federation in subjects of the Russian Federation according to appendix which are exported by this participant of foreign trade activity according to customs procedure of export from January 1, 2021 to December 31, 2022 (inclusive) through check points through frontier of the Russian Federation in each subject of the Russian Federation.
