About approval of Rules for apportionment of the liquefied oil gas emitted within the delivery plan out of commodity exchanges

According to subitem 18-8) of article 6 of the Law of the Republic of Kazakhstan "About gas and gas supply" PRIKAZYVAYU:

1. Approve the enclosed Rules for apportionment of the liquefied oil gas emitted within the delivery plan out of commodity exchanges.

2. To provide to department of the gas industry of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Department of Energy of the Republic of Kazakhstan;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules for apportionment of the liquefied oil gas emitted within the delivery plan out of commodity exchanges

Chapter 1. General provisions

1. These rules of distribution of the liquefied oil gas emitted within the delivery plan out of commodity exchanges (further – Rules) are developed according to subitem 18-8) of article 6 of the Law of the Republic of Kazakhstan "About gas and gas supply" (further – the Law) and determine procedure for distribution of the liquefied oil gas emitted within the delivery plan of the liquefied oil gas for the domestic market of the Republic of Kazakhstan out of commodity exchanges (further – the delivery plan).

2. In these rules the following concepts are applied:

1) vagononorma – the mass of the liquefied oil gas equal to thirty six tons;

2) the supplier – the producer of the liquefied oil gas or the owner of the liquefied oil gas made in the course of conversion belonging to him on the property right or other legal causes of hydrocarbonic raw materials to whom according to item 4 of article 27-1 of the Law the obligation of accomplishment of the delivery plan and distribution of the allocated amounts of the liquefied oil gas is assigned;

3) the request – the appeal to local executive body of areas, the cities of republican value and the capital, areas (cities of regional value) (further – local executive bodies) in form, according to appendix 1 to these rules;

4) authorized body - the central executive body performing state regulation of production, transportation (transportation), storage and wholesale of gas, and also retail sale and consumption of the commodity and liquefied oil gas;
