1. Approve the enclosed Rules of carrying out tender on determination of the legal entity performing functions of the administrator of system of guaranteeing the rights of citizens of the Republic of Kazakhstan in the field of outbound tourism.

2. To provide to committee of the industry of tourism of the Ministry of Culture and sport of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within three working days after its enforcement placement of this order on Internet resource of the Ministry of Culture and sport of the Republic of Kazakhstan;

3) within three working days after execution of the actions provided by this Item, submission to Department of legal service of the Ministry of Culture and sport of the Republic of Kazakhstan of data on execution of actions.

3. To impose control of execution of this order on the supervising vice-Minister for Culture and Sports of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of carrying out tender on determination of the legal entity performing functions of the administrator of system of guaranteeing the rights of citizens of the Republic of Kazakhstan in the field of outbound tourism

Chapter 1. General provisions

1. These rules of carrying out tender on determination of the legal entity performing functions of the administrator of system of guaranteeing the rights of citizens of the Republic of Kazakhstan in the field of outbound tourism (further - Rules), are developed according to the subitem 146) of Item 15 of the Regulations on the Ministry of the tourism and sport of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of October 4, 2023 No. 865.

2. In Rules the following basic concepts are used:

1) authorized body - the central executive body performing functions of public administration in the field of tourist activities;

2) the administrator of system of guaranteeing the rights of citizens of the Republic of Kazakhstan in the field of outbound tourism - the legal entity determined by authorized body which single type of activity is implementation of functions of the administrator of system of guaranteeing the rights of citizens of the Republic of Kazakhstan in the field of outbound tourism.

Chapter 2. Procedure for carrying out tender on determination of the legal entity performing functions of the administrator of system of guaranteeing the rights of citizens of the Republic of Kazakhstan in the field of outbound tourism

3. Tender on determination of the legal entity performing functions of the administrator of system of guaranteeing the rights of citizens of the Republic of Kazakhstan in the field of outbound tourism (further - tender), is carried out by authorized body.

For the purpose of carrying out tender the authorized body forms the commission on determination of the legal entity performing functions of the administrator of system of guaranteeing the rights of citizens of the Republic of Kazakhstan in the field of outbound tourism (further - the commission). The structure and provision of the commission affirm authorized body.

4. The commission in the activities is guided by the Constitution, the laws of the Republic of Kazakhstan, acts of the President of the Republic of Kazakhstan and the Government of the Republic of Kazakhstan, other regulatory legal acts, and also these rules.

5. The information message about carrying out tender is published on Internet resource of authorized body and the republican periodic printing edition not later than twenty calendar days before carrying out tender. The message on carrying out tender contains the following data:

1) name of authorized body and location of the commission;

2) methods of receipt of the detailed information about carrying out tender (contact telephone numbers, Internet resource, e-mail);

3) the address and term of reception of applications on participation in tender;

4) date, time and venue of tender;

5) the list of the documents provided for participation in tender according to Item 6 of Rules;

6) conditions on contents of the competitive offer according to Item 8 of Rules.

6. For participation in tender the following documents are submitted:

1) the statement on participation in tender in form according to appendix to Rules;

2) the competitive offer conforming to requirements of Item 8 of Rules;

3) copy of the reference or certificate on state registration (re-registration) of the legal entity;

4) copy of the charter of the legal entity. If the legal entity performs activities based on the standard charter approved according to the order of the Minister of Justice of the Republic of Kazakhstan of February 24, 2015 No. 106 "About approval of standard charters of the legal entities belonging to subjects of small, medium and big business" (No. 10563) is registered in the Register of state registration of regulatory legal acts of the Republic of Kazakhstan, then notarially attested copy of the application about state registration is submitted.

7. Discrepancy of the documents submitted for participation in tender to Item 6 of Rules is the basis for their return.

8. The competitive offer contains:

1) specifying on form of business of the legal entity;

2) location of the legal entity;

3) the information about the founder(s) of the legal entity (with application of a copy of the document confirming length of service in tourism industry; copies of the document confirming membership in consolidation of legal entities in tourism industry (in the presence);
