Regulations on procedure for restriction (renewal) for access to Internet resource, online media, news aggregator

1. This Provision establishes procedure for restriction (renewal) for access to Internet resource, online media, the news aggregator in the cases provided by articles 51-1 and 51-2 of the Law of the Republic of Belarus "About mass media".

2. For the purposes of this provision terms and their determinations in the values established by the Presidential decree of the Republic of Belarus of February 1, 2010 No. 60 "About measures for enhancement of use of national network segment the Internet", the Law of the Republic of Belarus "About mass media" and also the following terms and their determinations are applied:

the Internet resource identifier - domain name, the IP address, URL, other information allowing to identify Internet resource *;

the copy of Internet resource - the Internet resource similar to extent of mixing to Internet resource **, access to which is limited;

network port - the digital identifier used for designation of session of telecommunication by transport layer protocols.

3. The suppliers of Internet services rendering services in provision of access to global computer network the Internet (further - suppliers of Internet services), limit access to Internet resource *** on the basis:

the identifier list of Internet resources, access to which is limited (further - the identifier list), - to the organizations (except for the Ministries of information, the Ministry of Communications and Informatization, bodies performing operational search activities, bodies of prosecutor's office and pretrial investigation, bodies of the State Control Committee, tax authorities, courts, the State inspectorate of the Republic of Belarus for telecommunication of the Ministry of Communications and Informatization (further - the State inspection), other state bodies and the organizations determined by the Ministry of information), to physical persons, including individual entrepreneurs, on a grant basis;

the service provision agreement on access restriction to information distributed by means of Internet resources (further - services in access restriction) concluded between the user of Internet services and the supplier of Internet services.

4. The identifier list is obligatory for execution by all suppliers of Internet services in the territory of the Republic of Belarus and is created by the State inspection on the basis:

decisions of the Ministry of information on access restriction to Internet resource, online media, the news aggregator;

notifications of the Ministry of information on inclusion in the identifier list of copies of Internet resources;

resolutions of the Attorney-General, prosecutor of the region, the city of Minsk on access restriction to Internet resource, online media, the news aggregator;

the decisions of the State inspection made according to Item 12 of this provision.

The state inspection provides maintaining the identifier list in electronic form and storage on permanent basis of the data included in it.

5. Access to the identifier list is provided to the following users:

To the ministry of information;

To the Ministry of Communications and Informatization;

to the bodies performing operational search activities;

to bodies of prosecutor's office;

to bodies of pretrial investigation;

to bodies of the State Control Committee;

to tax authorities;

to courts;

to suppliers of Internet services;

to owners of news aggregators for execution by such owners of the obligation established by subitem 2-1.3 of Item 2-1 of article 30-1 of the Law of the Republic of Belarus "About mass media";

to owners of Internet resources by means of which products of television and (or) broadcasting mass media, access to which is provided for a fee and (or) on condition of viewing (listening) of the advertizing directed to drawing attention of the consumers who are in the territory of the Republic of Belarus (further - the Internet resource extending TV and (or) radio programs), for execution by such owners of the obligation established by subitem 2-2.4 of Item 2-2 of article 30-1 of the Law of the Republic of Belarus "About mass media" extend.
