About approval of the Procedure for processing and personal data protection in the Ministry of questions of strategic industries of Ukraine

1. Approve the Procedure for processing and personal data protection in the enclosed Ministry of questions of strategic industries of Ukraine.

2. To heads of structural divisions in which personal data are processed to assign responsible persons concerning personal data protection and to provide strict fulfillment of requirements of the Procedure for processing and personal data protection in the Ministry of questions of strategic industries of Ukraine approved by this order.

3. To provide to department concerning digital development, digital transformations and digitalization submission of this order on state registration in the Ministry of Justice of Ukraine in the procedure established by the legislation.

4. This order becomes effective from the date of its official publication.

5. To impose control over the implementation of this order on the state secretary Natalya ZAPOLSKAYA.

Procedure for processing and personal data protection in the Ministry of questions of strategic industries of Ukraine

I. General provisions

1. This Procedure determines general requirements to processing and personal data protection of subjects of personal data which are processed fully or partially using information communications systems, the state electronic information resources, the information (automated) systems, and also personal data containing in card-index or intended to entering into card-index in paper form.

2. This Procedure is mandatory government employees and other workers of the office of Minstrategprom to whom the information access is provided, containing personal data within accomplishment of the powers by them.

3. Terms in this Procedure are used in the values given in the Laws of Ukraine "About personal data protection" and "About information protection in information communications systems".

4. Any data or set of information about person according to which it is identified belong to personal data or it can be specifically identified.

5. Personal data which are processed, are information with limited access, except cases, the stipulated in Article 5 Laws of Ukraine "About personal data protection".

6. Personal data in information systems of Minstrategprom are processed is automated electronically by means of software and in paper form (storage of addresses, the requests for access to public information which arrived in paper form, the documents containing personal data of employees of Minstrategprom or candidates for occupation of vacant positions).

7. The owner of personal data is Minstrategprom.

8. The organization of the work connected with personal data protection of each category of subjects of personal data which processing is performed by Minstrategprom is provided by the responsible person concerning personal data protection (further - the responsible person) determined by the order of Minstrategprom. General control and the organization of personal data protection is performed by department of information security and information protection of Minstrategprom.

9. Personal data processing concerning which special requirements and/or which represents extra risk for the rights and freedoms of subjects of personal data are established is performed according to articles 7 and 9 of the Law of Ukraine "About personal data protection".

II. Purpose and bases of personal data processing

1. Personal data processing which owner is Minstrategprom is performed on purpose:

ensuring passing of public service and employment relationships, personnel management, conducting military and tax accounting;

providing the right of person to access to public services and information on electronic public services, the appeal to public authorities and local government bodies, the companies, organizations and the organizations, receipt of information from information systems which is necessary for provision of services;

record keeping concerning personnel management, administrative legal relations and the relations concerning financial accounting and/or preparation according to requirements of the legislation of statistical, management and other information on the questions which are within the competence of Minstrategprom;

ensuring implementation of requirements of the labor law about salary payment to employees of Minstrategprom through organizations of banks, about expense recovery and receipt of other compensations in connection with official journeys of workers, concerning data on compensation of the worker;

ensuring implementation of requirements of the pension legislation;

ensuring implementation of requirements of the tax legislation concerning representation of the tax calculation of income amounts added (paid) for benefit of taxpayers - physical persons, and the amounts of the tax withheld from them and also the amounts of the assessed single contribution;

rewarding with the state awards of Ukraine and marking with the state and departmental incentive distinctions of employees of Minstrategprom, and also heads of the state companies, organizations and the organizations relating to the sphere of management of Minstrategprom or activities of which goes and coordinated by the Cabinet of Ministers of Ukraine through the minister of strategic industries of Ukraine.

2. The bases for personal data processing, specified in Item 1 of this Section, are:

the permission to personal data processing provided to the owner of personal data according to the law only for implementation of its powers;

need of accomplishment of the obligation of the owner of personal data provided by the law.
