About payment procedure and the sizes of monetary compensations on gasoline, repair and maintenance of cars and on transport servicing

According to article 28 of the Law of Ukraine "About rehabilitation of disabled people in Ukraine" the Cabinet of Ministers decides:

1. Approve the Payment procedure of monetary compensations on gasoline, repair and maintenance of cars and on transport servicing which is applied.

2. Determine that monetary compensations on gasoline, repair and maintenance of cars are paid to disabled people, legal representatives of handicapped children who have cars and microcars, - in the amount of respectively 22 percent and 16 percent of subsistence minimum as like as two peas which incapacitated, per month, on transport servicing - in the amount of 29 percent of subsistence minimum as like as two peas which incapacitated, per month.

To persons which are marked out in subitems 2 and 5 of Item 14 of the Procedure approved by this resolution, payment of compensation on transport servicing is performed since January 1, 2008.

3. Recognize invalid:

the resolution of the Cabinet of Ministers of Ukraine of March 17, 1998 N296 "About Approval of the Regulations on Payment to Disabled People of Compensation on Gasoline, Repair and Maintenance of Cars and on Transport Servicing" (The Official Bulletin of Ukraine, 1998, N 11, the Art. 399);

Payment procedure of monetary compensations on gasoline, repair and maintenance of cars and on transport servicing

General part

1. Monetary compensations on gasoline, repair and maintenance of cars and on transport servicing (compensations are farther) are paid to disabled people, legal representatives of incapacitated disabled people of handicapped children who according to the legislation have the right to providing with cars.

On disabled people, handicapped children who are registered as internally displaced persons and having the right to providing with cars the personal record in their actual place of residence / stay according to the certificate of registration of the internally displaced person based on the documents provided by Items 9 and 15 of this Procedure is drawn up without assignment and payment of compensation. For assignment and payment of compensation the drawn-up personal records of disabled people, children - disabled people who moved from temporarily occupied territory go to structural division of social protection of the population of the Kherson region, and personal records of disabled people, handicapped children which moved from the territories of conducting anti-terrorist operation, - to structural divisions of social protection of the population at the registered place of residence.

2. Compensations are appointed:

to persons whose disability is connected with labor mutilation which came from labor accident or occupational disease (further - disabled people as a result of labor mutilation), - according to orders of managements of executive directorate of Social Insurance Fund from labor accidents and occupational diseases of Ukraine in the Autonomous Republic of Crimea, areas of Kiev and Sevastopol (further - management of executive directorate);

To disabled people of any other category - according to orders of the Ministry of social policy of the Autonomous Republic of Crimea, structural divisions concerning social protection of the population of the regional, Kiev and Sevastopol city state administrations (further - structural divisions of social protection of the population).

The order of management of executive directorate is drawn up in duplicate, the first - remains in management of executive directorate, and the second - remains in the personal record of the disabled person as a result of labor mutilation.

The order of structural division of social protection of the population is drawn up in duplicate, one of which remains in the personal record of the disabled person who is on accounting for providing with the car, and the second is sent to structural division of social protection of the population district, district in Kiev and Sevastopol to the state administration, executive committee of city, district council in the city (further - district structural division of social protection of the population).

3. Compensations are paid:

to disabled people as a result of labor mutilation - managements or departments of executive directorate;

to disabled people of any other category - district structural divisions of social protection of the population irrespective of body where the disabled person is on accounting as the receiver of pension (perpetual monetary pay or the government public assistance which is paid instead of pension).

4. Are not paid to disabled people and handicapped children who are in organizations of social servicing in complete state dependence in places of detention of compensation.

5. Compensations are paid equal by installments twice a year - in March for the first and in September for the second half of the year of the current year from the date of their assignment.

6. The amount of compensations overpaid because of the disabled person returns it voluntarily or is levied judicially.

7. In case of the death of the disabled person and the handicapped child of compensation, not paid timely for the reasons, independent of the disabled person, are paid to one of members of his family (in case of the consent of others).

8. Compensations are appointed to gasoline, repair and maintenance of cars:

1) to disabled people and handicapped children who are in accordance with the established procedure provided with the car;

2) to disabled people and handicapped children who have the right to providing with the car, but did not receive it and use the car acquired for own means of disabled people, legal representatives of incapacitated disabled people of incapacitated disabled people, handicapped children;

3) to disabled people and handicapped children who were provided in accordance with the established procedure with microcars.

9. For receipt of compensations on gasoline, repair and technical servicing of cars move:

1) statement;

2) log book about car registration addressed to the disabled person, the legal representative of the incapacitated disabled person of the handicapped child;

3) the copy of the certificate of the driver certified in established by the legislation of procedure;
