About creation of Expert and criminalistic service of the Ministry of Internal Affairs of the Kyrgyz Republic

For the purpose of increase in efficiency of activities of the Ministry of Internal Affairs of the Kyrgyz Republic for protection of rights and freedoms of man and citizen, according to articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:

1. Create Expert and criminalistic service of the Ministry of Internal Affairs of the Kyrgyz Republic.

2. Approve Regulations on Expert and criminalistic service of the Ministry of Internal Affairs of the Kyrgyz Republic according to appendix.

3. To the Ministry of Internal Affairs of the Kyrgyz Republic in three-months time in accordance with the established procedure:

- take the necessary measures following from this resolution;

- bring the decisions into accord with this resolution.

4. Determine that the expenses connected with implementation of this resolution are performed within the means provided to the Ministry of Internal Affairs of the Kyrgyz Republic in the republican budget for the corresponding years.

5. To impose control of execution of this resolution on management of control of execution of decisions of the President and the Presidential Administration Cabinet of Ministers of the Kyrgyz Republic.

6. This resolution becomes effective after ten days from the date of official publication.

Regulations on Expert and criminalistic service of the Ministry of Internal Affairs of the Kyrgyz Republic

1. General provisions

1. This Provision determines procedure for activities of Expert and criminalistic service of the Ministry of Internal Affairs of the Kyrgyz Republic (further - Service).

2. The service is subordinated division of the Ministry of Internal Affairs of the Kyrgyz Republic (further - the Ministry).

The service in the activities is guided by the Constitution of the Kyrgyz Republic, codes, the constitutional laws, the laws, other regulatory legal acts of the Kyrgyz Republic which came in the procedure established by the law into force international treaties which participant is the Kyrgyz Republic, orders and orders of the Ministry, and also this Provision.

- coordination of activities of divisions of law-enforcement bodies concerning judicial and expert activities;

- rendering the state services in research, the analysis, assessment and examination according to the legislation in the field of provision of the state services.

3. Functions of Service

11. The service performs the following functions:

- performs expert and criminalistic and judicial and expert activities in accordance with the established procedure;

- provides execution of orders of courts, prosecutors, investigators and bodies of inquiry by means of the organization of expert and criminalistic activities;

- applies special knowledge and technical means in research of objects of examinations, and also in survey of scenes for the purpose of detection, fixing, withdrawals, packagings of physical evidences;

- takes part in quality of the specialist in criminal, civil cases and cases on offenses;

- develops and participates in project development of regulatory legal acts of the Kyrgyz Republic in the field of judicial and expert activities;

- participates in development of program documents on judicial and expert activities;

- studies experience of expert organizations of foreign countries and implements new methods and techniques in expert practice, performs cooperation in the field of judicial and expert activities with foreign states and the international organizations within the competence, according to the legislation of the Kyrgyz Republic;

- creates, keeps and uses expert and criminalistic account, the state pulegilzoteka, the database of genomic information, and also other types of card-indexes and natural collections, information databases depending on requirements of law enforcement agencies;

- will organize work on certification of civil and office weapon and cartridges to it, and also products, structurally similar to them;

- will organize and carries out research works and developmental developments, their practical approbation;

- performs development and distribution of guidelines manuals and materials concerning judicial and expert and expert and criminalistic activities;
