In compliance Item 3 of article 15 of the Law of the Republic of Kazakhstan "About professional qualifications", PRIKAZYVAYU:

1. Determine the enclosed Rules of recognition of professional qualifications according to appendix 1 to this order.

2. To provide to development department of national system of qualifications and forecasting of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on official Internet resource of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Labour and Social Protection of the population of the Republic of Kazakhstan.

4. This order becomes effective since September 4, 2023 and is subject to official publication.

Rules of recognition of professional qualifications

Chapter 1. General provisions

1. These rules of recognition of professional qualifications (further – Rules) are developed according to Item 3 of article 15 of the Law of the Republic of Kazakhstan "About professional qualifications" (further - the Law) and determine procedure for recognition of professional qualifications.

2. The main terms and determinations used in these rules:

1) the qualification program – package of measures, used for assessment of conformity of the candidate applying for recognition of professional qualification, to requirements of professional standards, and in case of their absence – to qualification requirements to use of knowledge, skills in certain working conditions with use of certain equipment, methodology and (or) tools;

2) the center of recognition of professional qualifications (further – the center of recognition) – the legal entity accredited according to the procedure, established by the legislation of the Republic of Kazakhstan, the performing recognition of professional qualifications;

3) the document on recognition of professional qualification – the document certifying compliance of professional qualification of the candidate to requirements imposed to accomplishment of labor functions by certain profession;

4) the candidate applying for recognition of professional qualification (further – the candidate), – the physical person who addressed voluntarily, independently or in the direction of the employer for recognition of its professional qualification;

7) recognition of professional qualification – assessment procedure and decision makings about the candidate's compliance to requirements of professional standards, and in case of their absence – to qualification requirements;

8) online proktoring – system of verification of the personality and confirmation of results of passing of online examinations which provides preserving record, recognition and identification of the personality, the analysis of movements of the head and body, with determination of noise level, recognition of multiface, request for record of the room in the mode of 360 degrees, logging of suspicious events.

3. Recognition of professional qualifications is performed on voluntary basis by the professions included in the register of professions.

Chapter 2. Procedure for holding procedure of recognition of professional qualification

4. The candidate for recognition of professional qualification provides in the center of recognition in paper form or by means of digital platform of National system of qualifications (further – the NSK digital platform) the following documents:

1) the statement in form according to appendix 1 to these rules;

2) the copy of the education document and (or) the certificate of recognition of the education document, the document certifying training, including passing of short-term rates, references to persons which did not finish technical and professional, postsecondary education, the certificate or the certificate on completion of training for recognition of informal education;

3) the copy of the document confirming labor activity;

4) copies of documents on recognition of professional qualifications (in the presence).

The documents specified in subitems 2) and 3) of this Item are provided in case requirements to the education level and availability of working life are established by the corresponding professional standards, and in case of their absence – qualification requirements.

5. The center of recognition within three working days after day of registration of a statement checks completeness of the documents submitted by the candidate and correctness of filling of the statement.

In case of representation of incomplete document package and (or) the wrong filling of the statement, the center of recognition directs to the terms specified in part one of this Item to the candidate the motivated refusal signed by the head of the center of recognition in the conclusion of the service provision agreement on recognition of professional qualification in paper or electronic form by means of the NSK digital platform.

In case of submission by the candidate of complete document package and the correct filling of the statement in the terms specified in part one of this Item, the center of recognition signs with the candidate the service provision agreement on recognition of professional qualification.

6. Within five working days after day of the conclusion with the candidate of the service provision agreement on recognition of professional qualification the center of recognition sends to the candidate the notification on date, time and the venue of the procedure of recognition of professional qualification.

The period between date of the direction of the notification and date of recognition of professional qualification constitutes at least ten working days, except as specified, provided by Items 7 and 11 of these rules.

7. If the candidate did not undergo the procedure of recognition of professional qualification in the period of the temporary disability:
