1. Approve the enclosed instruction on the organization of anti-terrorist protection of objects, vulnerable in the terrorist relation, performing activities in the field of rail transport of the Republic of Kazakhstan.

2. To provide to committee of transport of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on the Internet - resource of the Ministry of the industry and infrastructure development of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-minister of the industry and infrastructure development of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

The instruction on the organization of anti-terrorist protection of objects, vulnerable in the terrorist relation, performing activities in the field of rail transport

Chapter 1. General provisions

1. This instruction on the organization of anti-terrorist protection of objects, vulnerable in the terrorist relation, performing activities in the field of rail transport (further – the Instruction) is developed according to Item 1 of article 10-2 of the Law of the Republic of Kazakhstan "About counteraction to terrorism" and determines the purposes, the principles and tasks in the organization of anti-terrorist protection.

The instruction disaggregates requirements to the organization of anti-terrorist protection of objects, vulnerable in the terrorist relation, provided by the order of the Government of the Republic of Kazakhstan of May 6, 2021 No. 305 "About approval of requirements to the organization of anti-terrorist protection of objects, vulnerable in the terrorist relation" (further – Requirements) and establishes actions for ensuring anti-terrorist security of objects, obligatory for accomplishment, vulnerable in the terrorist relation, performing activities in the field of rail transport.

General principles of anti-terrorist protection:

1) adequacy – comparability of the anti-terrorist measures applied on object to nature and specifics of probable terrorist threats;

2) complexity – the set of measures allowing to build anti-terrorist protection of object proceeding from the above-mentioned principles and to involve the having forces and means.

3) advance time (preventiveness) of the held events – package of measures, developed in advance taking into account nature and specifics of terrorist threats;

4) the differentiated approach – set of methods, the industry features of functioning of object, its dislocation directed to accounting;

This Instruction extends to objects of joint-stock company "The Kazakstan Tem_r Sholas national company, included in lists of objects vulnerable in the terrorist relation according to the order of the Government of the Republic of Kazakhstan of April 12, 2021 in No. 234 "About approval of Rules and criteria of reference of objects to vulnerable in the terrorist relation".

3. This Instruction is held for use the heads of objects, service employees providing holding actions for anti-terrorist security of the objects performing activities in the field of rail transport and also for the employees controlling and actuators when studying and checking condition of their anti-terrorist security of objects.

4. In this Instruction the following concepts are used:

1) the Company – joint-stock company "The Kazakstan Tem_r Sholas national company;

2) NZhS – JSC KTZh Oil Company branch - departments of the high-level network;

3) NODGP – KTZh-Gruzovye perevozki LLP branch;

4) object of UTO – object vulnerable in the terrorist relation;

5) the subject of security activities – the security organization which signed the agreement on safety control of object of UTO;

6) examination – inspection, including by application of technical or other means, passengers and visitors, the things which are in case of them including cabin baggage and baggage for the purpose of identification and/or detection of the substances and objects prohibited to bringing on object of transport infrastructure according to the list of objects of transport infrastructure on which examination according to the list of objects of transport infrastructure is made, on which examination is made, persons concerning whom examination is not made, the substances and objects prohibited to bringing on objects of transport infrastructure, the Minister of the industry and infrastructure development of the Republic of Kazakhstan approved by the order of April 18, 2022 to No. 213 (it is registered in the Register of state registration of regulatory legal acts for No. 27649) (further - the List), and it is carried out based on the Law of the Republic of Kazakhstan "About transport in the Republic of Kazakhstan";

7) control and management system for access (further – SKUD) – set technically the compatible hardware and (or) the software intended for access control, differentiation of the rights to entrance and (or) exit to object of UTO and (or) its separate zones of personnel and visitors, collection and storage of information;

8) television systems of protection – the system of video surveillance representing the television system of the closed type intended for identification and fixation of violations;

9) the warning system – set of the technical means intended for operational informing (light and (or) audible annunciation) UTO which are on object, persons about alarm in case of emergencies (accident, the fire, natural disaster, attack, act of terrorism) and actions in the developed situation;
