Some questions of provision of the complex electronic public service "emalyutka"

According to part one of article 12 of the Law of Ukraine "About features of provision public (electronic public) services" the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for provision of the complex electronic public service "emalyutka" which is applied.

2. Enter the enclosed changes to acts of the Cabinet of Ministers of Ukraine.

3. To provide to the ministries, other central executive bodies reduction of own regulatory legal acts in compliance with this resolution.

4. This resolution becomes effective from the date of, its publication following behind day.

Procedure for provision of the complex electronic public service "emalyutka"

1. This Procedure determines procedure for granting of the complex electronic public service "emalyutka" (further – the service "emalyutka"), and also the list of the data and/or documents necessary for its provision.

2. In this Procedure it is necessary to understand person as the term "child" age up to one year.

Other terms are used in the value given in the Laws of Ukraine "About features of provision public (electronic public) services", "About provision public (electronic public) services in declaring and registration of the residence in Ukraine", "About the Unified state demographic register and documents confirming citizenship of Ukraine, proving the identity or her special status", "About state registration of acts of civil status", "About government assistance to families with children", "About personal data protection", Bases of the legislation of Ukraine on health protection.

3. The service "emalyutka" consists of the following services:

1) state registration of the birth and determination of origin of the child;

2) declaring of the residence of the child;

3) purpose of the help in case of the child's birth;

4) entering of information about the child into the Register of patients in electronic health care system;

5) registration of the child in the State register of physical persons taxpayers;

6) entering of information on the child into the Unified state demographic register with automatic creation of unique number of record in it;

7) provision of monetary compensation of cost of the one-time natural help "Packet of the kid";

8) certification of parents of large family and the child from large family;

9) purpose of child allowance, brought up in large families.

The services which are part of the service "emalyutka" can be provided taking into account technical capabilities of realization of such services by means of the single state web portal of electronic services (further - the Action Portal) and information communications systems of state bodies, local government bodies, the companies, organizations and the organizations which can be involved for provision of the service "emalyutka".

4. The service "emalyutka" is provided on condition of obligatory election of the services determined by subitems 1, 4-6 Items 3 presents of the Procedure. If on the child the court makes the decision on factual determination of the birth of the child, the service determined by the subitem 4 Items 3 presents of the Procedure is not provided.

Other services determined by Item 3 presents of the Procedure are chosen according to the decision of parents / one of the child's parents.

Services to destination of child allowance, brought up in large families, and certification of parents of large family and the child from large family are chosen in case parents / one of parents applies/applies for purpose of benefit and provision of the corresponding status.

5. The service "emalyutka" is provided if:

parents of the child are citizens of Ukraine;

concerning the child the medical certificate about the birth (further - the medical certificate) or the health certificate on the birth was issued (form No. 103/about) or the court makes the decision on factual determination of the birth of the child;

at the time of filing of application the birth of the child is not registered by body of state registration of acts of civil status.

6. The service "emalyutka" is provided only on desire of parents of the child or one of them (further - the applicant) by filing of application about state registration of the birth (further - the statement) containing the data necessary for provision of services, 3 presents of the Procedure determined by Item.

In case when the information about the father of the child is entered in the State register of acts of civil status of citizens according to the statement of mother of the child according to part one of article 135 of the Family code of Ukraine, receipt of the service "emalyutka" is performed only according to the statement of mother.

7. In case when shall precede receipt of the services determined by Item 3 presents of the Procedure according to the legislation receipt of other service determined by Item 3 presents of the Procedure, such services by provision of the service "emalyutka" are provided according to the procedure of priority of their provision.

8. The applicant can submit the application one of the following methods:

personally through the Action Portal;

through the center of provision of administrative services;

directly in department of state registration of acts of civil status;

in the healthcare institution providing medical care in case of childbirth on condition of cooperation of department of state registration of acts of civil status and healthcare institution on the basis of the corresponding memorandum.

9. In case of the address through the center of provision of administrative services, department of state registration of acts of civil status, healthcare institution identification of the applicant is performed by presentation of the identity document and confirming citizenship of Ukraine.

10. The application is submitted by means of the Action Portal the applicant who underwent identification and authentication with use of the integrated system of electronic identification, the digital signature based on the qualified digital signature certificate or other means of electronic identification which allow to identify the applicant's personality unambiguously.
