1. Approve the enclosed Rules of maintaining the register of independent experts of medico-social examination, and also the basis of inclusion in the register and exceptions of it.

2. To provide to department of methodology and enhancement of medico-social examination of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Labour and Social Protection of the population of the Republic of Kazakhstan.

4. This order becomes effective since January 1, 2025 and is subject to official publication.

Rules of maintaining register of independent experts of medico-social examination, and also basis of inclusion in the register and exception of it

Chapter 1. General provisions

1. These rules of maintaining the register of independent experts of medico-social examination, and also the basis of inclusion in the register and exceptions of it (further – Rules) are developed according to Item 2 of article 156 of the Social code of the Republic of Kazakhstan (further – the Social code) and determine procedure for maintaining the register of independent experts of medico-social examination, and also the basis of inclusion in the register and exceptions of it.

2. The basic concepts applied in these rules:

1) Committee of regulation and control in the sphere of social protection of the population of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan (further – Committee) – the department of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan (further – the Ministry) performing realizable and control functions in the field of social and provision of pensions, social protection of persons with disability within the competence;

2) medico-social examination (further – MSE) – assessment of the restrictions of activity of osvidetelstvuyemy person caused by permanent disorder of functions of organism with establishment (not establishment) of disability and (or) extent of disability, and also determination of his needs for measures of social protection;

3) division of medico-social examination – the structural division of authorized state body which is carrying out medico-social expertize;

4) the independent expert of medico-social examination (further – the independent expert of MSE) – the physical person conforming to the requirements determined by authorized state body, and consisting in the register of independent experts of medico-social examination;

5) the register of independent experts of medico-social examination (further – the register) – the list of the independent experts participating in carrying out the correspondence pro-active survey with indication of profile of specialties;

6) the automated information system "Centralized Databank of Persons Having Disability" (further – AIS "TsBDI") – the hardware and software intended for automation of business processes on establishment of disability, disability, development of the individual program of abilitation and rehabilitation and also for storage and data processing on persons which underwent survey in departments of MSE;

7) authorized state body – the central executive body performing management and cross-industry coordination in the sphere of social protection of the population according to the legislation of the Republic of Kazakhstan, regulation, control functions behind activities of the State Social Insurance Fund;

8) the applicant – the citizen of the Republic of Kazakhstan who filed documents for inclusion in the register of independent experts of medico-social examination.

Chapter 2. Procedure for maintaining register of independent experts of medico-social examination

3. The register is kept by Committee in AIS "TsBDI" in form according to appendix 1 to these rules.

4. The announcement of the beginning of documents acceptance of applicants is published on the official site of Committee in 10 (ten) working days prior to documents acceptance.

The announcement contains information on terms of acceptance and on procedure for submission of documents, and also:

1) the name of the state body holding competition with indication of its location, the postal address, phone numbers, e-mail addresses;

2) the list of the necessary documents specified in Item 7 of these rules;

3) the name of specialties of independent experts of MSE and their number with designation of the fundamental functional obligations, the established rate and payment terms of services.

5. Electronic copies of the following documents are enclosed to the application for inclusion in the register:

1) the diploma about the higher, postgraduate education (residency) (in the presence) education on specialties: health care (general medicine, medical case, pediatrics);

2) the document confirming continuous working life at least 5 years on the declared medical specialty corresponding to the list of nosological forms in case of which the correspondence pro-active survey is carried out or in the field of MSE according to appendix 15 to the Order of the Deputy prime minister - the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of June 29, 2023 No. 260 "About approval of Rules of conducting medico-social examination" (it is registered in the Register of state registration of regulatory legal acts for No. 32922) (further – the Order No. 260);
