1. Approve the enclosed Rules of selection and determination of criteria of social and economic projects.

2. To provide to department of investment policy of the Ministry of national economy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan state registration of this order in the Ministry of Justice of the Republic of Kazakhstan and its placement on Internet resource of the Ministry of national economy of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-minister of national economy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of selection and determination of criteria of social and economic projects

Chapter 1. General provisions

1. These rules of selection and determination of criteria of social and economic projects (further - Rules) are developed according to Item 3 of article 32 of the Law of the Republic of Kazakhstan "About return to the state of illegally acquired assets" (further - the Law) and determine procedure for selection and determination of criteria of social and economic projects (further - projects) for financing at the expense of means of Special state fund.

2. In these rules the following concepts are used:

1) Special state fund (further - Fund) - the control account of cash opened in the central authorized body on budget implementation according to the Budget code of the Republic of Kazakhstan (further - the Code) for transfer of receipts and expenditure of money for the purpose of financing of social, economic projects of the Republic of Kazakhstan, and also expenses of authorized body on return of assets according to the procedure determined by the legislation of the Republic of Kazakhstan;

2) social projects - projects in the field of health care, education, support of socially unprotected segments of the population, persons with disability, orphan children, children without parental support, rural youth, the unemployed, objects of utility and welfare infrastructure for needs of residents of monotowns, rural settlements and other projects determined by the Government of the Republic of Kazakhstan;

3) economic projects - the projects aimed at the development of industries of economy, creation (upgrade) of the productions necessary for the solution of social and economic problems of the state.

Chapter 2. Procedure for determination of criteria of social and economic projects

3. Project development is performed by the central state bodies / local executive bodies in case of their compliance to the criteria determined by these rules.

4. Determination of criteria on projects is performed based on the principles of budget system determined by article 4 of the Code.

5. Criteria of the project definition are:

1) compliance of projects to documents of System of state planning, to annual president's letters of the Republic of Kazakhstan to the people of Kazakhstan and orders of the President of the Republic of Kazakhstan;

2) compliance of projects to one of the priority directions of budget investment policy (diversification of economy and infrastructure and innovative development, upgrade of the social sphere) according to the Forecast of social and economic development of the Republic of Kazakhstan;

3) compliance of projects on construction or reconstruction of objects technically to simple and (or) standard projects according to Rules of determination of general procedure for reference of buildings and constructions to technically and (or) technology difficult objects approved by the order of the Minister of national economy of the Republic of Kazakhstan of February 28, 2015 No. 165 (it is registered in the Register of state registration of regulatory legal acts for No. 10666);

4) compliance of projects to the System of regional standards for settlements approved by the joint order of the Minister of national economy of the Republic of Kazakhstan of April 20, 2019 No. 29, of the Minister of Education and Science of the Republic of Kazakhstan of April 23, 2019 No. 164, of the Minister of Health of the Republic of Kazakhstan of April 25, 2019 No. KR DSM-50, of the Minister of the industry and infrastructure development of the Republic of Kazakhstan of April 23, 2019 No. 243, of the Minister for Culture and Sports of the Republic of Kazakhstan of April 22, 2019 No. 113 and the Minister of digital development, the defense and aerospace industry of the Republic of Kazakhstan of April 25, 2019 No. 56/Tax Code (it is registered in the Register of state registration of regulatory legal acts for No. 18592).

5-1. In case of project initiation by the public and (or) lighting it in mass media, social networks, state bodies provide removal of the brought-up question at the relevant departmental commission for consideration of possibility of its realization by fund according to these rules.

5-2. The direction of fund on joint financing of projects in case of their compliance to the criteria specified in Item 5 of these rules is allowed.

6. The expenses relating to the current budget programs of state bodies and the quasi-public sector and also budget credits to local executive bodies, subjects of the quasi-public sector, financial institutions of development, banks of the second level and microfinancial institutions cannot be financed by fund.

Chapter 3. Procedure for selection of social and economic projects

7. The procedure for selection and realization of budget investments is performed according to Articles 152, of 153, of 154, 157 and 159 Codes.
