About the organization and functioning of the National agency on land reclamation
(Extraction)

Based on Item b) article 7 of the Law No. 136/2017 on the Government (The official monitor of the Republic of Moldova, 2017, No. 252, the Art. 412), with subsequent changes, parts (7) Articles 14, parts (1) Article 15 and part (2) article 32 of the Law No. 98/2012 on the central branch public management (The official monitor of the Republic of Moldova, 2012, Art. No. 160-164, 537), with subsequent changes, DECIDES: the Government

1. Create National land reclamation agency by reorganization (transformation) of public organization "Fund of Long-term Development — Moldova".

2. Approve:

1) Regulations on the organization and functioning of the National agency on land reclamation according to appendix No. 1;

2) Structure of the National agency on land reclamation according to appendix No. 2;

3) to Organigramm of National land reclamation agency according to appendix No. 3;

4) Changes which are made to some orders of the Government, according to appendix No. 4.

3. Establish the number of staff of the National agency on land reclamation in number of 19 units with the annual salary fund according to the legislation.

4. To perform release of personnel in connection with reorganization of public organization "Fund of Long-term Development — Moldova" according to the labor law.

5. To the ministry of the environment within three months from the effective date of this resolution to prepare and provide for approval to the Government the draft of the order of the Government about transfer of the real estate units which are public property of the state in hydrotechnical infrastructure of irrigation systems / drainage from management of the Ministry of the environment (maintaining the Apele Moldovei Agency) in management of the Ministry of Agriculture and the food industry (maintaining the National agency on land reclamation).

6. To public organization "Fund of Long-term Development — Moldova" or its legal successor for the purpose of ensuring accounting and monitoring of repayment and collection of remaining balance on the credits and other corresponding payments within 30 days to transfer to public organization "Office of Management of Programs of the External Help" the assets representing remaining balance of portfolio of granted loans, the main amount, percent and other means of Renewable loan fund and/or accounts of credit benefit of postharvest crediting in agricultural industry. Perform transfer of these assets by signing by agreement parties about reception-transmission with appendix of financial records.

To public organization "Office of Management of Programs of the External Help" which assumes the rights and obligations as the legal successor of the received assets, to recover debts of debtors of public organization "Fund of Long-term Development — Moldova" on granted loans and to organize through partner financial institutions of transaction on recrediting of the available current assets of the companies of the real sector for financing of acceptable irrigational projects, having provided thus continuity of transactions during the period after implementation of the Compact Program.

7. To the agency of the state services on a grant basis to make necessary changes to cadastral documents at the request of the owner according to provisions of this resolution.

8. Declare invalid the Order of the Government No. 903/2015 about public organization "Fund of Long-term Development — Moldova" (The official monitor of the Republic of Moldova, 2016, Art. No. 2-12, 8), with subsequent changes.

9. To impose control over the implementation of this resolution on the Ministry of Agriculture and the food industry.

10. This resolution becomes effective from the date of publication in the Official monitor of the Republic of Moldova.
