According to the Customs code of the Republic of Uzbekistan the State Customs Committee of the Republic of Uzbekistan DECIDES:

1. Approve Regulations on procedure for filling, execution of the transit declaration, introduction in it of changes and amendments, and also its response and cancellation according to appendix.

2. This resolution is approved with Chamber of Commerce and Industry of the Republic of Uzbekistan.

3. This resolution becomes effective after three months from the date of its official publication.

Regulations on procedure for filling, execution of the transit declaration, introduction in it of changes and amendments, and also its response and cancellation

This Provision determines procedure for filling, submission to customs authority, forming of the copy on paper, execution of the transit declaration, introduction in it of changes and amendments, its response and cancellation.

Section I. General provisions

1. In this Provision the following basic concepts are used:

the transit declaration - the document submitted to customs authority and used for goods control, imported on customs area of the Republic of Uzbekistan and moved with transit through the territory of the Republic of Uzbekistan, from customs authority of departure to customs authority of appointment with indication of data on goods and (or) vehicles;

the declaring person - person representing to customs authorities the transit declaration from own name or the customs clearance specialist or the other person, authorized to fill, sign and represent to customs authorities the transit declaration on behalf of the customs applicant;

the sender - person, data on whom are specified in transport documents, transferring goods for their transportation to carrier from own name;

the receiver - person accepting goods from own name to whom the carrier performing cargo hauling shall issue the goods transported by it, and also data on which are specified in transport documents, and in case of change of customs regime of goods - person having at the time of submission of the transit declaration powers to receive at customs authority in the order the declared goods after their customs clearance;

accompanying documents - business and transport documents;

carrier - the person transporting the goods which are under customs control, or being responsible for use of the vehicle;

transport documents - the bill of lading, delivery note or other documents confirming availability of the transportation agreement of goods and accompanying them in case of such transportation;

mistake in the transit declaration - discrepancy between information in the documents submitted for customs clearance and (or) information which is available in customs authorities and data in the transit declaration, and also false information in the transit declaration;

shortcoming of the transit declaration - the cases connected with insufficiency of the data necessary for customs clearance or incompleteness of documents which shall be provided together with the transit declaration;

modification of the transit declaration - modification of data of the transit declaration;

entering of amendments into the transit declaration - entering of new data into the transit declaration or amendment of the relevant documents;

withdrawal of the transit declaration - cancellation of the transit declaration as the document, effectual in law, by its return after registration in customs authority;

cancellation of the transit declaration - cancellation of the transit declaration as the document, effectual in law, by its cancellation after registration in customs authority;

the drawn-up transit declaration - the transit declaration registered by customs authority with putting down in the column "D" of the corresponding marks of customs authority meaning registration of departure by customs authority;

the registered, but not adopted transit declaration - the transit declaration registered by customs authority, but without message to the declaring person about acceptance through the automated information system "E-Tranzit" (further - AIS "E-Tranzit");

the adopted transit declaration - the transit declaration registered by customs authority, but which is not drawn up, the message about which acceptance is sent to the declaring person through AIS "E-Tranzit";

information exchange system - means of exchanging electronic messages, representation and acceptance of the relevant documents between customs authorities and the declaring persons through information systems with use of the digital signature.

2. Filling, forming of the copy on paper, execution of the transit declaration, introduction in it of changes and amendments, its response and cancellation are performed through AIS "E-Tranzit".

3. The declaring person for filling and submission to customs authority of the transit declaration shall enter AIS "E-Tranzit" by means of the digital signature assigned to it as physical person and to choose one of stated below:

carrier or the authorized person operating from his name (except for the driver), - the button "Carrier";

the physical person (driver) managing the vehicle which is transporting goods or passing in goods quality - the Driver button;

the authorized person acting on behalf of the customs broker rendering services to the customs applicant - the Employee of the Customs Broker button;

the consignee or the authorized person operating from his name - the Consignee button.

In case of the choice by the declaring person of the Employee of the Customs Broker button, in the certain allocated field with the name "Broker" identification taxpayer number (further - INN) the customs broker, its short name and the location (legal address) is specified.

4. The declaring person specifies in the field "Person Who Submitted Documents" surname, name, nationality of the physical person who submitted documents and data based on which the transit declaration is completed, and being responsible for the data containing in them, and also the personal identification number of physical person belonging to it (further - PINFL).

If person who submitted documents and responsible for the data specified in them is the nonresident who does not have PINFL, in the place of mark PINFL of person the 99999999999999 code is specified.

5. The transit declaration is created in AIS "E-Tranzit" by the declaring person by means of the Creation of the New Declaration button by the choice of type of the transported goods or the moving transport. At the same time data are entered into separately allocated fields of the available Sections with consecutive step-by-step transition according to numbers to each Section.

For example, transition to the Section "Information on Transport" of step 2 is impossible until in the Section "General information" of step 1 all necessary data are not specified.

Data on the goods transported by one vehicle according to one transport document can be entered in AIS "E-Tranzit". With distinctions on one of these conditions data are entered in AIS "E-Tranzit" separately.

For example, if goods are transported by two types (different) of vehicles or the transport document, they are brought in AIS "E-Tranzit" at the same time.

6. In AIS "E-Tranzit" the transit declaration is created:

on the goods transported by the vehicle - by means of the Sections "General Information", "Information on Transport", "Information on Load", "Guarantee and Charges" and "Generation of Documents";

on the goods transported by the rail vehicle - by means of the Sections "General Information", "Information on Load", "Charges" and "Generation of Documents".

7. The documents which are the basis for carrying out customs clearance are represented through interactive service "E-arkhiv". At the same time in the certain field AIS "E-Tranzit" the special number assigned to the documents created by the declaring person through interactive service "E-arkhiv" according to Item 8 of this provision is specified and remains.

8. The customs applicant or the authorized person operating from his name by means of the digital signature places in interactive service "E-arkhiv" the documents which are the basis for carrying out customs clearance for the purpose of forming of electronic archive.

To the documents placed in interactive service "E-arkhiv" special number with the direction about it the certified electronic notification automatically is assigned to the customs applicant or the authorized person operating from his name.

The documents placed in interactive service "E-arkhiv" can be changed and removed by the customs applicant or the authorized person operating from his name, except for the documents used in case of customs clearance.

In case of need of change of the documents used in case of customs clearance, documents are placed in interactive service "E-arkhiv" repeatedly according to the procedure, established by paragraph one of this Item.

The customs applicant can provide to the declaring person the special number assigned to the documents which are the basis for carrying out customs clearance through interactive service "E-arkhiv".
