About approval of Rules of development and registration (re-registration) of the passport of the territory of the Semipalatinsk area of nuclear safety

According to the subitem 9) Item 1 of article 5 of the Law of the Republic of Kazakhstan "About the Semipalatinsk area of nuclear safety" PRIKAZYVAYU:

1. Approve the enclosed Rules of development and registration (re-registration) of the passport of the territory of the Semipalatinsk area of nuclear safety.

2. To provide to department of nuclear power and industry of the Department of Energy of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Department of Energy of the Republic of Kazakhstan;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Department of Energy of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-Minister of Energy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication, but not earlier than January 1, 2024

Rules of development and registration (re-registration) of the passport of the territory of the Semipalatinsk area of nuclear safety

Chapter 1. General provisions

1. These rules of development and registration (re-registration) of the passport of the territory of the Semipalatinsk area of nuclear safety (further – Rules) are developed according to the subitem 9) of Item 1 of article 5 of the Law of the Republic of Kazakhstan "About the Semipalatinsk area of nuclear safety" and determine procedure for development and registration (re-registration) of the passport of the territory of the Semipalatinsk area of nuclear safety.

2. In these rules the following basic concepts are used:

1) authorized body in the field of use of atomic energy (further – authorized body) – the central executive body performing management in the field of use of atomic energy;

2) authorized body in the field of environmental protection – the central executive body performing management and cross-industry coordination in the field of environmental protection and environmental management and also its territorial authorities;

3) the Semipalatinsk area of nuclear safety – the limited part of the territory of the Republic of Kazakhstan which underwent to above-standard radioactive pollution owing to testing of nuclear weapon in the territory of the former Semipalatinsk test nuclear test site on which the special legal regime, stipulated by the legislation the Republic of Kazakhstan acts;

4) the passport of the territory of the Semipalatinsk area of nuclear safety – the document in which contain system of the indicators characterizing the territory, the schematic map with indication of the location of the territory and functional zones, designation of infrastructure facilities of the Semipalatinsk area of nuclear safety, geographical coordinates, the description of borders, the areas of its territory, protection mode types permitted and the prohibited types of activity, rules of visit, operating mode, the information about adjacent owners of the parcels of land and land users about their obligations;

5) authorized organization for ensuring functioning of the Semipalatinsk area of nuclear safety (further – authorized organization) – the legal entity determined according to the subitem 4) of article 1 of the Law of the Republic of Kazakhstan "About the Semipalatinsk area of nuclear safety" for ensuring functioning of the Semipalatinsk area of nuclear safety from among the state companies which are under authority of authorized body.

3. The passport is constituted in the state and Russian languages in triplicate. Each copy of the registered passport is authentic.

4. One copy of the passport is in authorized body, the second – in authorized organization, third – in authorized body in the field of environmental protection.

Chapter 2. Procedure for development of the passport of the territory of the Semipalatinsk area of nuclear safety

5. Development of the passport is performed by authorized organization within 6 (six) months from the date of decision making of the Government of the Republic of Kazakhstan about creation of the Semipalatinsk area of nuclear safety.

6. The passport is developed in form according to appendix to these rules.

7. Accounting data on the Semipalatinsk area of nuclear safety are provided in the passport of the moment of its creation.

8. The authorized organization bears responsibility for quality assurance and accuracy of the information, specified in case of development of the passport.

Chapter 3. Order of registration (re-registrations) of the passport of the territory of the Semipalatinsk area of nuclear safety

9. The authorized organization submits the developed passport of registration in authorized body within terms according to Item 5 of these rules.

10. The re-registration of the passport is made in the following cases:

1) at least 1 (one) time in 10 (ten) years;

2) changes of borders, land areas of the Semipalatinsk area of nuclear safety;

3) changes of information containing in the passport.

11. In cases, stipulated in Item 10 these rules, the authorized organization develops the passport in form according to appendix to these rules and represents it on re-registration to authorized body within 3 (three) months".

12. In case of discrepancy of the provided passport to appendix to these rules the authorized body within 20 (twenty) calendar days sends the passport to completion of authorized organization.

13. The authorized organization represents the modifed passport of registration (re-registration) to authorized body no more than 3 (three) months in time.

14. Registration (re-registration) of the passport is performed by authorized body within 30 (thirty) calendar days from the date of its receipt.

15. Registration (re-registration) of the passport is drawn up by the order of the first head of authorized body, or person fulfilling its duties.
