About protection of professional activity of the journalist
The purpose of this Law is regulation of the relations in the field of protection of professional activity of the journalist.
The legislation on protection of professional activity of the journalist consists of this Law and other acts of the legislation.
If the international treaty of the Republic of Uzbekistan establishes other rules, than those which are stipulated by the legislation the Republic of Uzbekistan about protection of professional activity of the journalist then are applied rules of the international treaty.
The journalist - person performing activities for collection, the analysis, editing, preparation and distribution of messages and materials for mass media on the basis of employment or other contractual relations.
In the Republic of Uzbekistan censorship of mass media is not allowed.
Nobody has the right to demand from the journalist of preliminary approval of the published messages or materials, and also change of the text or their complete removal from seal (air).
When implementing professional activity the journalist has the right:
collect, analyze, edit, prepare and distribute information;
address to state bodies, self-government institutions of citizens, public associations, the companies, organizations and the organizations behind receipt of information;
get access to documents, materials and information, except for those which contain the state secrets or other secret protected by the law;
make journalistic investigation;
distribute through mass media the prepared messages and materials behind the signature or under pseudonym, to express in them the opinion;
be present at open joint sessions and other public actions of state bodies;
be the accepted official in connection with journalism implementation;
make in accordance with the established procedure records, including with use of necessary technical means;
be present at open sessions of court, at zones of military operations, natural disasters, at mass actions;
address specialists for verification of the data prepared for the publication;
refuse the assignment given it by mass media if it is connected with violation of the law;
not sign the message prepared by it or material which content, in his opinion, is distorted in the course of editing, or to require removal it from seal (air);
require preserving in secret source of information or name of the author;
require judicially compensation of moral harm and compensation of the material damage caused to it by the mass media which allowed misstatement of information provided by the journalist in case of the publication;
enter public associations, including the international organizations of journalists.
The journalist has also other rights granted to him by the legislation.
When implementing professional activity the journalist shall:
follow requirements of the legislation and rules of international treaties of the Republic of Uzbekistan;
check reliability of the prepared materials and provide the objective information;
adhere to the principle of presumption of innocence;
not disclose journalistic secret;
follow rules of professional ethics of journalists;
respect the rights and freedoms, honor and advantage of the personality.
The journalist cannot trade on professional information, publish the facts about private life of physical person, and also use the audio-and video writing down means without the consent of source of information or the author.
The journalist performs also other duties, stipulated by the legislation.
Journalistic secret are confidential information, and also the facts and events about which citizens voluntarily reported or other sources of information with condition not to disclose their name.
The journalist is forbidden to disclose the data which are journalistic secret without the permission of information source, and also to use these data in the selfish interests or interests of the third parties.
Rules of professional ethics of journalists represent the code of the provisions determining requirements imposed to the identity of the journalist and his behavior in case of accomplishment of professional obligations.
Rules of professional ethics of journalists are determined by associations of journalists and mass media.
The journalist in case of execution of professional obligations uses guarantee of integrity of human beings.
Prosecution of the journalist for the publication of critical materials is not allowed.
The journalist has the right to collect information and to make journalistic investigation.
The journalist has the right to extend results of the professional investigation in mass media, to voluntarily present them to state bodies, self-government institutions of citizens, public associations, the companies, organizations, the organizations and officials. At the journalist the materials and documents received during journalistic investigation cannot be withdrawn or subjected to examination.
The rights, honor and advantage of the journalist are protected by the law.
The state guarantees to the journalist free receipt and distribution of information, provides its protection when implementing of professional activity by it.
Intervention in professional activity of the journalist, the requirement from it any data received in case of execution of professional obligations is forbidden.
The journalist can be accredited under state body, public association and the organization.
The journalist of the Republic of Uzbekistan can be accredited in foreign state.
The foreign journalist can be accredited in the territory of the Republic of Uzbekistan in coordination with the Ministry of Foreign Affairs of the Republic of Uzbekistan.
The accredited journalist has the right:
to beforehand obtain information on the forthcoming open joint sessions and other public actions;
visit buildings (room) and other objects of accrediting body according to the procedure, established by accrediting body;
be present at open joint sessions and other public actions;
request and receive necessary documents and materials from responsible persons of accrediting body, to get acquainted with records of public actions and to make copies of them;
