Construction regulations and rules of the Republic of Tajikistan of the ISS of THURSDAY 11-01-2005 "Structure and procedure for development, approval and approval of the project documentation on construction of the companies, buildings and constructions"

1. Range of application

1.1. MK.S CHT 11-01-2005 establish procedure for development, approval, approval and structure of the project documentation on new construction, expansion, reconstruction and modernization (further - construction) the companies, buildings and constructions in the territory of the Republic of Tajikistan and are intended for application by customers (investors), the project organizations, executive bodies of the government, the companies, associations, other legal entities and physical persons - participants of investment process (including, foreign).

2. General provisions

2.1. Development of the project documentation on construction of facilities is performed, on the basis of the approved (approved) reasons for investments into construction of the companies, buildings and constructions. The project documentation disaggregates the decisions made in reasons and the main technical and economic indicators are specified.

2.2. In case of development of the project documentation it is necessary to be guided legislative and regulations of the Republic of Tajikistan, this Regulations and rules, and also other state documents regulating investing activities on creation and reproduction of fixed assets.

2.3. The main project document for construction of facilities is, the feasibility statement (FS) on construction. Based on the feasibility study for construction approved in accordance with the established procedure, the project documentation is developed.

2.4. The main document governing the legal and financial relations, cross liabilities and responsibility of the parties is the agreement (contract) signed by the customer with the project organization. The design assignment shall be integral part of the agreement (contract).

The design assignment is constituted by the customer with participation of the project organization.

2.5. The recommended structure and content of design assignment for subjects to production assignment are given in appendix 1, of subjects to housing-civil assignment - in appendix 2.

2.6 Designing of construction objects shall be performed by the legal entities and physical persons which acquired in accordance with the established procedure the right to the corresponding type of activity.

2.7. The customer on contract basis, can delegate the appropriate rights to the legal entities and physical persons having the right to that and to confer on them responsibility for development and project implementation.

2.8. Customers and designers are responsible for development of the project documentation at the high level, taking into account achievements of the advanced equipment and technology and shall make timely the changes connected with enforcement of new regulating documents.

Construction of facilities on obsolete projects is not allowed for what in case of their approval it is necessary to check compliance of the made decisions to modern technological level.

2.9. The choice of site (route) for construction of buildings and constructions is performed according to the requirements stated in annex 3.

3. Procedure for development of the project documentation

3.1. Development of the project documentation is performed in the presence of the approved decision on preliminary approval of the site area and other preproject materials - agreements, design assignment, materials of engineering researches.

When designing the companies, buildings and constructions of production assignment it is necessary to consider the decisions made in schemes and drafts of the district layout, master plans of the cities, settlements and rural settlements, site plannings of living, industrial and other functional areas.

Designing of subjects to construction engineering assignment is performed according to the approved master plans of the cities, settlements and rural settlements and projects of building developed on their basis.

3.2. The procedure for development of working documentation in one stage "the working project" or in two stages - "projects" and "working documentation" is determined by design assignment.

Staging of development of the design estimates is determined taking into account need of further disaggregation and refining of the main technical solutions.

Without determination of source of investment designing of construction objects is not allowed.

3.3. When designing particularly complex and unique buildings and constructions (appendix 4) by the customer, together with the relevant research and specialized organizations, the special specifications reflecting specifics of their designing, construction and operation shall be developed.

3.4. Reasonable departures from requirements of regulating documents are allowed only in the presence of permissions of bodies which claimed and (or) enacted these documents.
