On regulation of the address of weapon

This law is directed to protection of life, health and property of the person, ensuring public safety, strengthening international cooperation in fight against arms trafficking and crime.

Chapter 1. General provisions

Article 1. Subject of regulation of the law

1. This law regulates turnover of civil, office and person-portable military small arms in the Republic of Armenia and the legal relationship arising in case of traffic in weapons.

Article 2. The basic concepts used in this Law

1. In this Law the following basic concepts are used:

1) products of military appointment weapon, ammunition, military equipment, military property, military works and services, information and results of intellectual activities military and educational, military and technical or military and applied scientific or military, including exclusive rights on them (intellectual property);

2) Weapon - the device or subject intended for defeat, neutralization of live or other purpose or giving of signal. 9) ammunition - objects of arms, equipment and the metayemy devices intended for defeat of the purpose, containing explosive, propellant, pyrotechnic, extrusion powder or their combination;

10) the boss - the device intended for shot from weapon, combining in single whole by means of sleeve explosive means, propellant powder and metayemy adaptation;

11) weapon production turnover, trade, sale, finishing, repair, transfer, acquisition, creation of collections and their demonstration, accounting, preserving, storage, carrying, transportation (transportation), use, donation, inheritance, destruction, import to the territory of the Republic of Armenia and export from the Republic of Armenia (further respectively import and export), transit transportation and intermediary activities in trade;

12) production of weapon based on the license - research, development, repair, testing, production, assembly of weapon, the main components of firearms, cartridges and ammunition in production process, production of ammunition, cartridges, sleeves, their components;

13) award weapon - the encouragement type provided by persons determined by this Law within the powers allocated for them by the legislation in accordance with the established procedure;

14) accessories to weapon: butt, sight, case for storage, devices for cleaning, types of the fire extinguisher and muffler for barrel or the accessory developed or adapted for storage, placement, transportation of weapon or for improvement of navodimost of weapon by means of the optical, night or thermovision device by attachment fixtures to weapon. Belonging to weapon is considered also any other belongings to weapon which is not considered the main component of weapon or does not replace it.

17) transportation (movement) of weapon - movement of weapon out of storage location limits in the discharged condition, in covers, holsters or special cases, and also in the extra packing of the arms manufacturer intended for transportation in the box of throwing weapon packed and leaky fixed on the person, and the throwing device shall be divided;

18) educational weapon - the device or subject used in the educational purposes which cannot be repaired and suitable for defeat or neutralization of live or other purposes or for giving of signal. The emasculated weapon can also be educational weapon.

19) repair of weapon - reduction of weapon in the working condition by replacement or repair of the main parts of weapon, constructive change of nonbasic parts of weapon, at the same time tactical technical characteristics of weapon do not change;

20) finishing of weapon - decorating of weapon in case of which tactical technical characteristics of weapon do not change;

21) weapon collection - set of the chosen weapon which can have cognitive, historical, scientific, art, cultural and information value;

22) the emasculated weapon - the weapon put out of commission for firing;

23) gas weapon - according to requirements of the technical regulation, the device similar to the gun or the revolver, with the cartridges equipped with tear gas or irritating with substances, cartridges to them or the blowing-off (disseminating) device intended for temporary neutralization of the live purpose;

24) the boss of gas action - the device intended for shot from gas weapon, combining in the single whole by means of sleeve of means of initiation equipped, the allowed for use, tear or irritating substances established by the Government and not intended for causing death to the person;

25) the boss of light-sound action - the device intended for firing, including the incendiary substance (shell) and charge of sound action in one block through cartridge which is not intended for defeat of live or other purpose;

26) the educational boss - the adaptation used only for the educational purposes consisting of the capsule and the subject which is thrown out by flammable charge manufactured according to the sizes and design of the original and in which capsule there is no propellant powder, or it is replaced with other nonflammable material of the same weight, and flammable means (cartridge) is damaged shot);

27) the bezsnaryadny boss - the device used only for the educational purposes and educational shots, which is not intended for defeat of live or other purpose and including incendiary substance (shell) and propellant powder in one unit through cap, and the subject which is not containing shell or is available substitute from easily destroyed material (polymer, paper);

28) explosive - the chemical or mix of substances capable to blow up in case of external impact;

29) the destructive device - any specially manufactured device capable to blow up under certain conditions;

30) alarm weapon - the device intended for giving of light, smoke or sound signal by bezsnaryadny bullet;

31) the alarm boss - the device intended for shot from firearms or alarm weapon, combining in single whole by means of sleeve of means of initiation, propellant powder and metayemy equipment for giving of light, smoke or sound signal and not intended for defeat of live or other purpose;

32) gunpowder - the explosive mix consisting of different components which can be burned according to parallelism of its layers without penetration of oxygen from external environment. burning of gunpowder according to parallelism of layers which does not lead to explosion and leads to steady gas generation, allows to regulate gas generation speed.

33) electroconvulsive weapon - according to requirements of the technical regulation - the device like the gun, the spark plug and other charger intended for temporary neutralization of the live purpose by means of the stun gun;

34) firearms of limited vulnerability (traumatic) - the short-barreled weapon and aimless weapon intended for mechanical defeat of the live purpose in space by means of energy of bullet, the gunpowder or other charge directed due to energy of bullet, gunpowder or other collection;

35) the boss of traumatic action - the device intended for firing from firearms of the pricking action or firearms of limited vulnerability (traumatic), the including incendiary substance (cap), charge of shell and metayemy subject of the injuring action in whole by means of cartridge;

36) the legal entity who is carrying out special authorized tasks organizations which in the procedure established by the legislation perform the functions connected using or use of weapons;
