About price regulation on products intended for dietary food in healthcare institutions

Based on subitem 2.1 of Item 2 of the Presidential decree of the Republic of Belarus of February 25, 2011 "About some questions of price regulation (rates) in the Republic of Belarus" the Ministry of anti-monopoly regulation and trade of the Republic of Belarus DECIDES: No. 72

1. Approve the Instruction about procedure for establishment and use of prices for products intended for dietary food in healthcare institutions it (is applied).

2. This resolution becomes effective since September 15, 2023.

The instruction about procedure for establishment and use of prices for products, intended for dietary food in healthcare institutions

1. This Instruction determines procedure for establishment and use of prices for products, intended for dietary food in healthcare institutions (further - dietary food).

2. Action of this Instruction extends on legal entities and the individual entrepreneurs enabling product sales, intended for dietary food, in healthcare institutions and (or) organizing dietary food (further - subjects of food).

3. For the purposes of this Instruction terms and their determinations in the values established by the Law of the Republic of Belarus of May 10, 1999 No. 255-Z "About pricing" and also the following terms and their determinations are used:

the importer - the legal entity or the individual entrepreneur performing commodity importation on the territory of the Republic of Belarus for its further realization;

the wholesale allowance - the allowance to selling price applied by the legal entity or the individual entrepreneur when implementing wholesale trade by goods concerning which it or it is not the producer, the importer, the legal entity or the individual entrepreneur conducting procurement and storage of agricultural products;

selling price - the price established by the producer on made (including according to the works agreement) goods, the importer on the goods for its further realization imported by it into the Republic of Belarus, the legal entity or the individual entrepreneur conducting procurement and storage of agricultural products for its further realization;

the producer - the legal entity or the individual entrepreneur performing production of goods or being owners of the goods made according to the works agreement;

retail price - the price established by the subject of food on products (goods) intended for dietary food;

the trade allowance - the allowance to the selling price applied by subjects of food when pricing on the goods including used as raw materials for production, intended for dietary food.

4. Retail price on products intended for dietary food is established proceeding from goods price, used as raw materials for production, intended for dietary food, and markup in the amount of, not exceeding 40 percent if other is not established by this Instruction.

5. Goods price, used as raw materials for production, intended for dietary food, is established by subjects of food proceeding from selling price, the value added tax (if the cost of the raw materials used for production of dietary food includes tax amount on value added), the trade allowance (taking into account the wholesale allowance).

If when holding in accordance with the established procedure procurement procedure the price of the supplier with whom the agreement is signed will be below selling price of the producer (importer), the trade allowance is applied to lower price.

6. The limiting maximum trade allowance (taking into account the wholesale allowance) to selling prices on the goods including used as raw materials for production, intended for dietary food, is established in the amount of 20 percent.

7. When forming retail price for 1 unit of piece weight food product in case of its calibration are applied the trade allowance in the amount of, not exceeding established in Item 6 of this Instruction, and also markup in the amount of which is not exceeding 20 percent.

Calibration of piece weight goods is drawn up by the act of calibration on each batch.

8. Retail prices on the purchased food products which are not exposed to culinary processing are created without application of markups.

Retail prices on the purchased consumer goods intended for consumption a la carte (by division of purchased goods into portions according to the weight or amount specified in the menu) and in pouring (by the organization of consumption of drinks from the opened consumer packaging with pouring in the corresponding portion ware), are created taking into account the markup which is not exceeding 20 percent.

When using drinking butylated water for preparation of drinks trade allowances and surcharges are not imposed.

9. If the organization of dietary food is performed directly by healthcare institutions at the expense of budgetary funds, the markup on the made products intended for dietary food is not applied.

10. Calculation of retail prices on products intended for dietary food is performed in calculation cards which are constituted separately on each dish (culinary product, semifinished product).

The calculation cards and other documents proving the level of the applied prices are stored on papers and (or) electronically, including on material carriers.

11. Retail prices on goods are established by the head (other authorized person) of the subject of food. In case of establishment of retail prices on goods calculation with indication of the size of the applied trade allowance to selling price of the producer (importer), markup shall be constituted.

12. For the purpose of observance of the set restrictions when pricing subjects of food shall provide availability on the arriving goods of the data connected with establishment of regulated prices for such goods: selling price, discount type (from selling price, wholesale), the wholesale allowance.

13. Retail price of products (goods) intended for dietary food is rounded to integer of kopeks.
