About approval of the Procedure for maintaining the State register of oil and gas wells

According to part five of article 5-1 of the Code of Ukraine about subsoil the Cabinet of Ministers of Ukraine decides:

1. Approve the Procedure for maintaining the enclosed State register of oil and gas wells.

2. Item 19 of the Procedure for the state accounting of fields, inventories and shows of minerals approved by the resolution of the Cabinet of Ministers of Ukraine of January 31, 1995 No. 75 (ZP of Ukraine, 1995, No. 4, Art. 99; Official Bulletin of Ukraine, 2004, No. 51, Art. 3345; 2020, No. 2, the Art. 62) to exclude.

Procedure for maintaining the State register of oil and gas wells

1. This Procedure determines the procedure of functioning and maintaining the State register of oil and gas wells, fillings by its data on oil and gas wells and information access of the State register.

2. In this Procedure terms are used in the following sense:

the administrator of the State register of oil and gas wells - the company determined by Gosgeonedrami treats the sphere of management of Gosgeonedrami or concerning which Gosgeonedrami powers on management of corporate laws of the state are performed (including its affiliated enterprises) that provides functioning and performs administration of the State register;

The state register of oil and gas wells (further - the State register) - the information communications system providing collection, accumulating, protection, accounting, display, processing and provision of information on oil and gas wells;

the applicant owner or the user of oil and gas well who carries out works on drilling of such well observes its condition, performs hydrocarbon production and submits electronically the application, information specified in Item 24 presents of the Procedure and the electronic passport copy of oil and gas well for registration of oil and gas well in the State register;

the public logger of the State register - the official determined by the holder and the administrator of the State register who performs registration actions in the State register;

the technical administrator of the State register - the company determined by Gosgeonedrami, relating to the sphere of management of Gosgeonedrami or concerning which Gosgeonedrami powers on management of corporate laws of the state are performed (including its affiliated enterprises), providing in the limits and amounts defined by the agreement, maintenance, functioning and administration of the State register.

Other terms are used in the value given in the Code of Ukraine about subsoil, the Laws of Ukraine "About oil and gas", "About features of provision public (electronic public) services", "About national infrastructure of geospatial data", "About information protection in information communications systems", "About electronic communications", "About electronic confidential services", "About public electronic registers", "About electronic documents and electronic document management", "About personal data protection".

3. The owner of the State register and exclusive property rights on its software is the state on behalf of Gosgeonedr, providing information protection in the State register and control of it according to the Law of Ukraine "About information protection in information communications systems".

4. The purpose of creation and maintaining the State register is ensuring accounting of oil and gas wells on single procedure, providing public authorities, local government bodies, companies, organizations, organizations and the public with necessary data on such wells.

5. The state register is component of single state electronic geographic information system of use of natural resources.

6. The main objectives of functioning of the State register are:

accounting of oil and gas wells;

creation, collection, obtaining, storage, use, the order, distribution, protection, information protection in the field of geological studying and rational use of subsoil;

ensuring electronic interaction between physical persons and legal entities, physical persons entrepreneurs, public authorities, local government bodies for the purpose of accomplishment of the tasks determined by the legislation in the field of geological studying and rational use of subsoil, in particular the information processing created in the course of activities of subsoil users;

identification of invalid oil and gas wells, evaluating their further use, and also taking measures to liquidation or repair of such wells, determination of condition and possibility of development of mineral resources of the oil and gas industry, work planning on geological studying of oil-and-gas subsoil, evaluating relikvidation and degreasing of oil and gas wells;

increase in transparency and efficiency of accomplishment of the tasks connected with geological studying and rational use of subsoil;

information processing about oil and gas wells, created in the course of activities of subsoil users;

obtaining, consideration and processing of the electronic documents filed by applicants with automatic fixing of time of sending and obtaining, ensuring integrity and authenticity of electronic documents;

systematization and generalization of information, its conversion to the format suitable for carrying out the further analysis;

ensuring availability of information containing in the State register for persons with disability according to requirements of DSTU EN 301549:2022 "Information technologies. Requirements to product availability and services ICT";

preserving, automatic reservation and recovery of information entered in the State register, ensuring uninterrupted access to the State register;

ensuring electronic information exchange with other electronic information resources of public authorities, local government bodies, subjects of provision of basic data for the purpose of implementation of the powers determined by the legislation in the field of geological studying and rational use of subsoil.
