About entering of amendments into the Criminal code of the Republic of Armenia

Article 1. Article 81 of the Criminal code of the Republic of Armenia of May 5, 2021 to add with parts 1.1-1.3 following of content:
"1.1. If the crime which is commited by person for the first time is heavy or especially heavy, then in the presence of the exclusive factors connected with role of the criminal, his behavior in case of crime execution or after it and other circumstances, but can be exempted from criminal liability if cooperates with criminal prosecution authorities, does not dispute the act incriminated to him, in case of damnification compensated or otherwise smoothed the damage caused by crime. Both separate attenuating circumstances, and set of these circumstances can be recognized exclusive.
1.2. Person cannot be exempted from criminal liability on the basis provided by part 1.1 of this Article, Articles 133-154, 188, part 2 Articles 196, Articles 308, of 419, of 420, of 425, Item of 1 part 2 Articles of 441 of this Code, Articles 450, of 522, of 523, by parts 2 and 3 of Article 549, provided by parts 2 and 3 of Article 550, and also crime executions for which also lifelong imprisonment is provided.
1.3. If the victim from crime is person which did not reach 14-year age or owing to problems with mental health or lagging in intellectual development is fully or partially deprived of opportunity to realize nature and effects of the crime directed against it or to direct the behavior, then person who committed crime against it cannot be exempted from criminal liability on the basis provided by part 1.1 of this Article.".
Article 2. This law becomes effective for the tenth day from the date of its official publication.
