About some questions of the Unified state register of data on bankruptcy

Based on subitem 5.11 of Item 5 of article 12 of the Law of the Republic of Belarus of December 13, 2022 No. 227-Z "About insolvency settlement", subitem 6.1 of Item 6 of the Regulations on the Ministry of Economics of the Republic of Belarus approved by the resolution of Council of Ministers of the Republic of Belarus of July 29, 2006 No. 967, the Ministry of Economics of the Republic of Belarus DECIDES:

1. Determine the republican unitary enterprise "Information Centre of the Ministry of Economics of the Republic of Belarus" the operator by ensuring technical and organizational functioning of the Unified state register of data on bankruptcy.

2. Establish the list of the data which are subject to placement in the Unified state register of data on bankruptcy on paid and non-paid basis according to appendix.

3. Approve Regulations on procedure for forming and maintaining the Unified state register of data on bankruptcy, payment procedure of services of the operator in ensuring technical and organizational functioning of the Unified state register of data on bankruptcy it (is applied).

4. Forming and maintaining the Unified state register of data on bankruptcy, placement of the data and expense recovery connected with inclusion of data in the Unified state register of data on bankruptcy on cases on economic insolvency (bankruptcy) on which production is initiated by the court considering economic cases till October 1, 2023 are performed according to the legislation existing before entry into force of this resolution.

5. Declare invalid the resolution of the Ministry of Economics of the Republic of Belarus of December 17, 2013 No. 93 "About determination of the operator on ensuring technical and organizational functioning of the Unified state register of data on bankruptcy and approval of the Instruction about procedure for activities of the operator for ensuring technical and organizational functioning of the Unified state register of data on bankruptcy".

6. This resolution becomes effective since October 1, 2023.

The list of the data which are subject to placement in the Unified state register of data on bankruptcy on paid and non-paid basis

1. The data which are subject to placement on paid basis:

1.1. data on appointment of the interim (anti-recessionary) manager (further if other is not established, - the managing director) and release it from fulfillment of duties;

1.2. the accepted court decrees;

1.3. the notification on monthly expenditure and balance in cash on the current (settlement) bank account of the managing director, listed according to Item 1 of article 34 of the Law of the Republic of Belarus "About insolvency settlement";

1.4. announcements of carrying out creditor meetings (committee meetings of creditors) with indication of date, time, the place, the agenda and method of carrying out creditor meetings (committee meetings of creditors) and placement of voting bulletin, protocols of creditor meetings (committee meetings of creditors);

1.5. the term of presentation of requirements of creditors and the postal address to which requirements of creditors are accepted;

1.6. data on realization of property of the debtor (the notification on tendering, the decision of the organizer of the biddings on refusal of their carrying out, data on results of the biddings, on recognition invalid the biddings, information on the agreements signed by results of the biddings with indication of date of their conclusion, type of such agreements and property value, information on the signed direct agreements on realization of property with indication of date of their conclusion, type of such agreements and property value, data on recognition invalid the agreements signed by results of the biddings);

1.7. the offer to creditors to count unrealized property of the debtor satisfactions of their requirements, information on the concluded bargains on transfer of such property with indication of date of their making, type of such transactions, the size of the met requirements and cost of the transferred property;

1.11. changes and (or) amendments in the plan of sanitation of the debtor - the legal entity or the liquidation plan of the debtor - the legal entity or the plan of the termination of activities of the debtor - the individual entrepreneur.

2. The data which are subject to placement on a grant basis:

2.1. the information about managing directors - physical persons:

surname, own name, middle name (if that is available) the managing director;

contact telephone numbers, the e-mail address (in case of its availability), the postal address, bank details, details of e-wallets (in case of their availability), accounting number of the payer;

data on certification;

data on the agreement of obligatory civil liability insurance of interim (anti-recessionary) managers in insolvency proceedings or bankruptcy, including about the term of its action;

2.2. the information about managing directors - legal entities:

full and abbreviated name of the managing director;

data on the location of the managing director;

contact telephone numbers, the e-mail address (in case of its availability), the postal address, bank details, details of e-wallets (in case of their availability), accounting number of the payer;

data on the agreement of obligatory civil liability insurance of interim (anti-recessionary) managers in insolvency proceedings or bankruptcy, including about the term of its action;

surname, own name, middle name (if that is available) the managing director's head;

data on certification of the head of the managing director;

2.3. data on insolvency matters or bankruptcy and on cases on the disputes connected with insolvency or bankruptcy:

2.3.1. surname, own name, middle name (if that is available) the debtor - the individual entrepreneur, the name of the debtor - the legal entity, bank details, details of e-wallets (in case of their availability), accounting number of the payer;
