Chapter I. General provisions

Article 1. Basic concepts

For the purpose of this Federal Law the following concepts are applied:

fire safety - condition of security of the personality, property, society and state from the fires;

the fire - the uncontrollable burning causing material damage, harm of life and to health of citizens, interests of society and state;

mandatory requirements of fire safety (further - requirements of fire safety) - the special conditions of social and (or) technical nature established for the purpose of ensuring fire safety with the Federal Laws and other regulatory legal acts of the Russian Federation and also regulating documents on fire safety;

violation of requirements of fire safety - failure to carry out or inadequate fulfillment of requirements of fire safety;

fire prevention regime - set of the subjects of the Russian Federation established by regulatory legal acts of the Russian Federation, regulatory legal acts and municipal legal acts on fire safety of the requirements of fire safety determining rules of conduct of people, procedure for production organization and (or) content of the territories, the parcels of land, buildings, constructions, premises of the organizations and other subjects to protection for the purpose of ensuring fire safety;

measures of fire safety - action for ensuring fire safety, including for fulfillment of requirements of fire safety;

fire protection - set of the governing bodies created in accordance with the established procedure, divisions and the organizations intended for the organization of prevention of the fires, their suppression and carrying out the wrecking assigned to them;

primary measures of fire safety - realization of the regulations and rules accepted in accordance with the established procedure on prevention of the fires, rescuing of people and property from the fires.

rescue and fire fighting garrison - set of the governing bodies located in certain territory, divisions and the organizations irrespective of their departmental accessory and patterns of ownership to which functions prevention and suppression of the fires, and also carrying out wrecking are referred;

the organization of suppression of the fires - set of the operational and tactical and technical actions (except for actions for providing primary measures of fire safety) directed to rescuing of people and property from dangerous factors of the fire, liquidation of the fires and carrying out wrecking;

particular fire prevention regime - the additional requirements of fire safety established by public authorities or local government bodies in case of increase in fire risk in the corresponding territories;

fire localization - the actions directed to prevention of possibility of further distribution of burning and creation of conditions for its liquidation by the available forces and means;

coordination in the field of fire safety - activities for ensuring interrelation (interaction) and coordination of elements of system of ensuring fire safety;

fire-proof promotion - informing society on ways of ensuring fire safety;

training in measures of fire safety - organized process on forming of knowledge, abilities, skills of citizens in the field of ensuring fire safety in system of general, professional and additional education, in the course of labor and office activity, and also in everyday life;

management in the field of fire safety - activities of the bodies participating in accordance with the legislation of the Russian Federation in ensuring fire safety;

fire zone - the territory in which there is threat of damnification of life and to health of citizens, property of physical persons and legal entities as a result of impact of dangerous factors of the fire and (or) actions for fire extinguishing and carrying out the wrecking connected with fire extinguishing are performed;

independent assessment of fire risk (audit of fire safety) - assessment of conformity of subject to protection to requirements of fire safety and the check of observance by the organizations and citizens of fire prevention regime which is carried out by the expert who is not interested in results estimates or checks in the field of assessment of fire risk;

the expert in the field of assessment of fire risk - the official certified according to the procedure, established by the Government of the Russian Federation, performing activities in the field of assessment of fire risk, having special knowledge in the field of fire safety, necessary for carrying out independent assessment of fire risk (audit of fire safety), and authorized on signing of the conclusion about independent assessment of fire risk (audit of fire safety);

Article 2. Legislation of the Russian Federation on fire safety

The legislation of the Russian Federation on fire safety is based on the Constitution of the Russian Federation and includes this Federal Law, the Federal Laws and other regulatory legal acts, and also the laws and other regulatory legal acts of subjects of the Russian Federation, municipal legal acts regulating questions of fire safety adopted according to it.

The legislation of subjects of the Russian Federation is not effective in the part establishing lower, than this Federal Law, requirements of fire safety.

Article 3. System of ensuring fire safety

System of ensuring fire safety - set of forces and means, and also the measures of legal, organizational, economic, social and scientific and technical nature directed to prevention of the fires, their suppression and carrying out wrecking.

Basic elements of system of ensuring fire safety are public authorities, local government bodies, the organizations, the citizens who are taking part in ensuring fire safety in accordance with the legislation of the Russian Federation.

Main functions of system of ensuring fire safety:

normative legal regulation and implementation

the state measures in the field of fire safety;

creation of fire protection and organization of its activities;

development and implementation of measures of fire safety;
