About Offers on standardization of legal acts of state members of EurAsEC concerning recognition and equivalence of education documents

The bureau of Inter-parliamentary Assembly decides:

1. Approve Offers on standardization of legal acts of state members of EurAsEC concerning recognition and equivalence of education documents (are applied).

2. Send Offers to parliaments of state members of EurAsEC, the Secretariat of Integration Committee for use in work on harmonization of national legal systems and enhancement of system of law of Community.

Offers on standardization of legal acts of state members of EurAsEC concerning recognition and equivalence of education documents

These Offers on standardization of legal acts of state members of EurAsEC are directed to forming of general approach in questions of legal support (mechanism) of mutual recognition and establishment of equivalence of education documents in state members of Eurasian economic community.

In the document the main directions are considered and measures for rapprochement of levels of requirements imposed to education documents of the states of Community and also for establishment of the identical procedure of recognition of equivalence taking into account the conventional principles and rules of international law are proposed.

Offers are prepared for the purpose of development of the contractual legal base of EurAsEC in the field of education which foundation was laid by signing on February 26, 1999 of the Agreement on the Customs union and the Common economic space, and also within the organization-legal actions for project development of Bases of the legislation of EurAsEC on education.

1. General provisions

Education systems of state members of EurAsEC have single historical roots, common goals and the principles, long experience of joint development.

However process of independent development of educational systems of state members of EurAsEC led to emergence of discrepancies in requirements to content of education and level of training of graduates of educational institutions, in lists of professions and specialties. Level of availability of education decreased, possibilities of experience exchange, joint use of cumulative scientific and pedagogical potential decreased. As a result, now education systems of the states of Community cannot carry out fully the consolidating and creating role in forming of single educational space without streamlining of mutual recognition and establishment of equivalence of documents on academic degrees and the relevant unified legislation.

2. International standards in the field of education

According to preamble of the Constitutive treaty of Eurasian economic community state members of EurAsEC confirm the commitment to the conventional principles and rules of international law.

According to interstate agreements and, considering rules of international law, state members of EurAsEC undertook obligations to aim at rapprochement of education systems, including organizational structures, content, forms and training methods, introductory requirements and requirements to graduates, for the purpose of providing:

 access for children and youth to education in any of gosudarstvchlen of EurAsEC with option of educational institution;

 the rights of graduates of professional educational institutions to employment in any state of Community;

 mobility of school students, students, graduate students, teachers and scientists within single (general) educational space;

 recognitions of levels, steps and periods of training, education documents, academic degrees and ranks;

 improvement of quality of education at all its levels and in all types of educational institutions, especially in higher educational institutions, by strengthening of scientific preparation, establishment of reasonable ratios between amounts of general education, all-special and professional training, use of innovative technologies and training methods, raisings of qualification level of pedagogical personnel;

 developments of single mechanisms and quality evaluation methods of education.

The conventional principles and rules of international law regulating questions of education in state members of EurAsEC are:

- The Universal Declaration of Human Rights and the citizen of December 10, 1948;

- The International Covenant on Economic, Social and Cultural Rights of December 19, 1966;

- Convention of the UN on the child's rights (Art. 29);

- The Bologna declaration of June 19, 1999 which provides rapprochement of standards and assessment procedures for the purpose of mutual recognition of mechanisms of assessment, control and certification of quality of education. Their realization assumes the solution of number of questions.

1. Development of the compatible control systems oriented not to temporary and informative process parameters, and to threshold standards of the higher education which establish requirements to level of training of graduates (results).

In threshold standards (regulations) of quality of the higher education the shift of emphases from quantitative and costly indicators on result indicators is supposed: competence, proficiency, knowledge.

2. Creation of systems of independent estimation by means of establishment of the European quality label for wide subject domains of the higher education (quality control without national borders). Perspective forming of accreditation structures and the all-European networks, independent of the state and all-European authorities, in objects (profiles, specialties, the directions of preparation). It is supposed that these accreditation structures will begin to establish the minimum standards for separate disciplines or their sets, and also to initiate procedures of measurement at the level of separate educational programs (objects). It will grant the right to award the Quality labels based on the European standards which are not distorted by national tables of ranks (national league tables).

3. Coordinating of approaches to the quality standards of transnational education (franchizing, offshore structures; campuses and their networks; private and training companies; tweening; provayderny universities and agencies; virtual universities, etc.). In the conditions of the accruing offer of educational services by network of providers of transnational education extremely urgent is problem of quality of the education delivered by them. In this regard new systems and control procedures of quality of the higher education are created. Along with single systems of estimation for all sectors of the higher education (university and not university levels) specialized bodies of estimation for each subject domain (profession, the educational program) on condition of independent nature of estimation are created; unalterability of postaccreditation effects in case of the solution of questions of allocation of government subsidies (the principle of management and financing "by results").
