About paid training in public service

The parliament adopts this organic law.

Chapter I General provisions

Article 1. Subject and purposes of the law

This law regulates procedure for planning, the organization and holding paid training in public service for persons aged from 18 up to 29 years inclusive for the purpose of:

a) accumulatings/consolidations of knowledge, development of professional skills of trainees in case of execution of powers and obligations in area in which the training will be organized;

b) implementation by trainees of activities and their acquaintance with requirements of the accepting body;

c) acquaintance of trainees with specifics of activities of the accepting body, and also with its requirements;

d) acquisitions by trainees of working experience, practical skills and/or competences;

e) simplification to trainees of transition from education system to the labor market;

f) assistance of social integration, expansion of variety and ensuring equality, and also fight against stereotypes and prejudices.

Article 2. Basic concepts

For the purpose of this law the following concepts mean:

the accepting body - body of the public power in which the training will be organized and held;

training allowance - monthly sum of money to which the trainee as a result of its participation in training according to the agreement on training has the right;

the certificate on completion of training - the document certifying period of time during which the trainee worked under the agreement on training, and also the performed activities and the mark which is put down following the results of estimation issued by the accepting body upon termination of training;

the agreement on training - the agreement signed between the trainee and the accepting body for certain term based on which the trainee shall have professional training and perform certain type of activity under the direction of the accepting body which in turn shall provide to the trainee payment of grant and create it all conditions necessary for goal achievement, stipulated in Article 1;

the additional agreement on training – the agreement signed between the trainee and the accepting body in which the trainee passed the training paid from external sources, for the purpose of accumulating of necessary number of hours for completion of the complete program of training;

the coordinator of training - person designated by the head of the accepting body for the organization and holding training;

the national coordinator of training - the function which is carried out by the State office through the division responsible for management of the state position and government employees;

the reserve case of trainees – the trainees who finished the complete program of training within the accepting body and received assessment "it is very good", but which were not offered for appointment to executive state position;

the mentor - person designated by the accepting body who coordinates informs and directs the trainee, gives it necessary support during passing of training, carries out monitoring of its activities and estimates it;

the activities report – the document on the performed activities constituted by the trainee before the end of training;

the thematic report – the document containing the analysis of the area connected with activities of the trainee in the accepting body;

the valuation report - the document constituted by the mentor upon termination of training in which the activities performed by the trainee are estimated and the corresponding mark is put down;

the trainee - person passing training based on the agreement on training for goal achievement, stipulated in Article 1;

training - the activities performed by the trainee in the accepting body for the purpose of receipt of practical knowledge, development of professional skills and/or acquisition of new abilities, and also forming of the professional approach / behavior necessary for implementation of activities in certain area.

Article 3. Scope of the law

The training is held:

a) in the Secretariat of Parliament of the Republic of Moldova;

b) in the Office of the President of the Republic of Moldova;

c) in the State office;

d) in the ministries and administrative authorities which are under their supervision;

e) in the central administrative authorities subordinated to the Government.

Chapter II Planning, organization and holding training

Article 4. Planning, organization and holding training

(1) Training are planned by annually national coordinator of training in cooperation with the Ministry of Finance within the planned places for the current year after carrying out consultations about requirements with the bodies of the public power specified in Article 3.

(2) the Accepting body annually plans certain number of places for training, proceeding from requirements and the extreme number of staff of body of the public power. From total number of places for training ten percent are provided for persons with limited opportunities. If the ten-percentage quota allocated for persons with limited opportunities is not executed, the remained vacancies are redistributed between other participants of tender.

(3) Training will be organized and held by the accepting bodies.

(4) In departure from provisions of parts (2) and (3) training which shall be held in the administrative authorities subordinated to the ministries are planned and will be organized by the ministries.

(Duration of one training constitutes 5) no more than 480 hours within no more than six months in a row. Activities duration within the training cannot exceed 40 hours a week. The term of training can be prolonged no more than for six months in a row for the documented reasonable reasons.

(6) Training can be planned, organized and held from external sources within the accepting bodies in cooperation with partners in development with whom they signed agreements on cooperation in this direction, with the notification of the national coordinator of training.

(7) the Procedure for planning, the organization and holding training affirms the Government.

Article 5. Selection of trainees

(1) Selection of trainees is performed on competitive basis.

(2) the National coordinator of training and the accepting body provide informing the public by means of the www.stagii.gov.md portal and the official web page of this body about the forthcoming training by placement of the announcement with the invitation to take part in tender, about conditions and selection criteria, about terms of holding training, procedure of selection, powers and the trainee's obligations, contractual conditions, and also about results of tender on selection of trainees.

(3) Financing of training, including payment of training allowance, is provided from planned by the accepting body of the annual budget and/or from the external sources provided by partners in development based on agreements on cooperation between the parties.
