1. Approve the enclosed Rules of appointment and implementation of retirement benefits for long service to military personnel, the staff of special state and law enforcement agencies, the public courier service, and also persons which right to have special ranks, class ranks and to wear uniform are abolished since January 1, 2012, and to persons whose medical positions are reduced in law-enforcement bodies of the Republic of Kazakhstan since July 1, 2022 and on January 1, 2023, having at the time of reducing position length of service at least twelve years and six months of continuous military service, service in special state and law enforcement agencies, the public courier service, on condition of continuation of work by them in the medical organizations located in pre-trial detention centers and organizations of criminal and executive (penitentiary) system.

2. Recognize invalid some decisions of the Government of the Republic of Kazakhstan according to appendix to this resolution.

3. This resolution becomes effective after ten calendar days after day of its first official publication and extends to the legal relationship which arose since July 1, 2023.

Chapter 1. General provisions

1. For the purposes of these rules the following concepts are used:

1) retirement benefits – payment on age, for long service, from the single accumulation pension fund, from insurance company, from the Voluntary accumulation pension fund;

2) retirement benefits for long service – payment by the serviceman, to the staff of special state and law enforcement agencies, the public courier service, and also persons which right to have special ranks, class ranks and to wear uniform are abolished since January 1, 2012, and to persons whose medical positions are reduced in law-enforcement bodies of the Republic of Kazakhstan since July 1, 2022 and on January 1, 2023, having at the time of reducing position length of service at least twelve years and six months of continuous military service, service in special state and law enforcement agencies, the public courier service, on condition of continuation of work by them in the medical organizations located in pre-trial detention centers and organizations of criminal and executive (penitentiary) system according to the Code;

3) The Government for Citizens State corporation (further – the State corporation) – the legal entity created according to the decision of the Government of the Republic of Kazakhstan for rendering the state services according to the legislation of the Republic of Kazakhstan, the organization of work on reception of applications and issue of their results to uslugopoluchatel by the principle of "one window", ensuring rendering the state services electronically;

4) authorized organization for issue of pensions and benefits – the banks of the second level, the organizations having licenses of authorized body on regulation, control and supervision of the financial market and the financial organizations on the corresponding types of banking activities, territorial subdivisions of Kazpochta joint-stock company;

5) branches of the State corporation – branches of the State corporation of areas, cities of republican value and the capital;

6) the centers of rendering special social services – the organizations created according to the decision of local executive bodies and providing special social services to persons (families) needing special social services in the conditions of hospital, semi-hospital, temporary stay and at home;

7) the centralized database (further – TsBD) – the centralized database of authorized state body for implementation of payment types on the conditions established by the Code;

8) medico-social examination (further – MSE) – assessment of the restrictions of activity of osvidetelstvuyemy person caused by permanent disorder of functions of organism with establishment (not establishment) of disability and (or) extent of disability, and also determination of his needs for measures of social protection.

Chapter 2. Procedure for purpose of retirement benefits for long service

2. Purpose of retirement benefits is for long service performed by the relevant authorized state bodies:

1) the Ministry of Defence of the Republic of Kazakhstan – the serviceman serving in Armed Forces, bodies of military prosecutor's office;

2) the Ministry of Internal Affairs of the Republic of Kazakhstan – to the military personnel and employees serving in law-enforcement bodies, bodies of civil protection, the public courier service and also persons whose medical positions are reduced in law-enforcement bodies of the Republic of Kazakhstan since July 1, 2022 and on January 1, 2023, having at the time of reducing position length of service at least twelve years and six months of continuous military service, service in special state and law enforcement agencies, the public courier service, on condition of continuation of work by them in the medical organizations located in pre-trial detention centers and organizations of criminal and executive (penitentiary) system;

3) Committee of homeland security of the Republic of Kazakhstan – to the military personnel and employees serving in bodies of homeland security and Service of foreign intelligence of the Republic of Kazakhstan Syrbar;

4) Service of the state protection of the Republic of Kazakhstan – to the military personnel and employees serving in Service of the state protection of the Republic of Kazakhstan;

5) the Prosecutor General's Office of the Republic of Kazakhstan – to the employees serving in bodies of prosecutor's office (except for bodies of military prosecutor's office);

6) financial monitoring Agency of the Republic of Kazakhstan – to the employees serving in Service of economic investigations;

7) anti-corruption Agency of the Republic of Kazakhstan (Anti-corruption service) – to the employees serving in anti-corruption service.

3. Purpose of retirement benefits for long service to persons which right to have special ranks, class ranks and to wear uniform are abolished since January 1, 2012, it is performed on the last duty station by the relevant authorized state bodies specified in Item 2 of these rules.

The authorized state bodies specified in Item 2 of these rules (further – authorized state bodies), determine the list of documents according to the instruction for disaggregation of the these rules confirming service, and the size of monetary pay on the date of dismissal of the serviceman, the employee of special state, law enforcement agencies, the public courier service, and also persons which right to have special ranks, class ranks and to wear uniform are abolished since January 1, 2012, and persons whose medical positions are reduced in law-enforcement bodies of the Republic of Kazakhstan since July 1, 2022 and on January 1, 2023, at least twelve years which had length of service at the time of reducing position and six months of continuous military service, service in special state and law enforcement agencies, the public courier service, on condition of continuation of work by them in the medical organizations, located in pre-trial detention centers and organizations of criminal and executive (penitentiary) system. Documents acceptance is performed by the relevant structural divisions of authorized state bodies, including departments or territorial authorities (further – divisions).
