About procedure for making of actions by the national operators authorized by operators (bodies) and monitoring bodies in case of emergency situation and (or) implementation of unauthorized action during tracking of transportation of subjects to tracking on the territories of state members of the Eurasian Economic Union using navigation seals

1. Approve the enclosed Procedure for making of actions by the national operators authorized by operators (bodies) and monitoring bodies in case of emergency situation and (or) implementation of unauthorized action during tracking of transportation of subjects to tracking on the territories of state members of the Eurasian Economic Union using navigation seals.

2. This Decision becomes effective after 30 calendar days from the date of its official publication.

Procedure for making of actions by the national operators authorized by operators (bodies) and monitoring bodies in case of emergency situation and (or) implementation of unauthorized action during tracking of transportation of subjects to tracking on the territories of state members of the Eurasian Economic Union using navigation seals

1. This Procedure determines rules of making of actions by the national operators monitoring transportation of subjects to tracking on the territories of state members of the Eurasian Economic Union (further respectively - transportation, state members), in case of emergency situation and (or) implementation of unauthorized action, national operators and authorized operators (bodies) of other state members, and also monitoring bodies of state members to which information on emergence of emergency situation and (or) implementation of unauthorized action is transferred.

2. The concepts used in this Procedure are applied in the values determined by the Agreement on application in the Eurasian Economic Union of navigation seals for tracking of transportations of April 19, 2022.

3. If when tracking transportation the navigation seal registered in information system of the national operator of state member in the territory of whom transportation tracking begins and such information system is used information on emergence of emergency situation and (or) implementation of unauthorized action received during transportation tracking is fixed, the specified national operator in perhaps short time performs transfer of the acquired information to the authorized operator (body) of the state member (except for case when the national operator and the authorized operator (body) are one person).

4. If when tracking transportation the navigation seal registered in information system of the national operator of other state member than state member in the territory of which transportation tracking began is used, information on emergence of emergency situation and (or) implementation of unauthorized action is fixed in information system of the national operator of state member in which the navigation seal is registered, and goes such national operator to the authorized operator (body) of the state member.

The authorized operator (body) of state member after receipt of the specified information sends it to the authorized operator (body) of state member in the territory of which tracking of such transportation began.

5. After receipt of information on emergence of emergency situation and (or) implementation of unauthorized action the authorized operator (body) of state member in the territory of which transportation tracking began sends such information to perhaps short time to the authorized operator (body) of state member in the territory of which there was emergency situation and (or) unauthorized action is performed.

6. For the purpose of elimination of effects of the arisen emergency situation and (or) acceptance of necessary response measures in case of implementation of unauthorized action the authorized operator (body) of state member in the territory of which there was emergency situation and (or) unauthorized action is performed, provides interaction with authorized operators (bodies) of other state members on which territories will be transported subjects to tracking, and also with monitoring body and the national operator of the state member (are transported).

7. The authorized operator (body) of state member in the territory of which there was emergency situation and (or) unauthorized action, within 30 minutes after receipt of information according to Item 5 of this Procedure is performed:

a) establishes the location of subjects to tracking, and in case of lack of communication with navigation seal - the location of subjects to tracking on the last information exchange with navigation seal;

b) depending on event which happened to navigation seal performs the actions connected with confirmation of this information, if necessary contacts the driver of the automotive vehicle (railway carrier) and specifies circumstances of emergence of emergency situation and (or) implementation of unauthorized action;

c) in case of confirmation of this information or in case of impossibility of communication within 30 minutes with the driver of the automotive vehicle (railway carrier) creates and sends to monitoring body of the state member the message on emergence of emergency situation and (or) implementation of unauthorized action, and also according to Item 6 of this Procedure to authorized operators (bodies) of state members on which territories will be transported subjects to tracking (are transported).

8. Monitoring body of state member in the territory of which there was emergency situation and (or) unauthorized action is performed:

a) informs the authorized operator (body) of the state member on adoption of the message on emergence of emergency situation and (or) implementation of unauthorized action;

b) holds necessary events for response to the arisen emergency situation and (or) the performed unauthorized action, including with use of risk management system;

c) by results of the held events for response to the arisen emergency situation and (or) the performed unauthorized action informs the authorized operator (body) of the state member on one of the following decisions:

about need of short circuit of element of sealing;

about need of deactivation of navigation seal and completion of tracking of transportation using such seal;

about need of replacement of navigation seal and (or) element of sealing of navigation seal;

about transportation continuation (including by change of the configured settings of navigation seal depending on transportation conditions).
